Rats reportedly infested the Houston Police Department’s narcotics evidence vault, disturbing and tearing into stored items. Officials first became aware of the problem in October 2024 and discussed it publicly on January 10, 2025. “Drug-addicted rats” was a colorful description—not a veterinary diagnosis. Later records reported by ABC13 in December 2025 described a vault containing more than 81,000 items, including nearly 12,000 with marijuana or THC products, but they did not establish that every item or criminal case was compromised.
What happened in Houston’s evidence room?
The incident involved HPD’s property and evidence-storage system, specifically a vault holding narcotics evidence. At a January 10, 2025 press conference, Mayor John Whitmire, Police Chief Noe Diaz and Harris County District Attorney Sean Teare addressed an overflowing property room and plans to process older evidence.
According to ABC13’s December 13, 2025 account of HPD-released photographs, videos and emails, an October 29, 2024 email documented the issue’s emergence. A December 16 email said rats were knocking over and tearing open evidence and had moved into another vault area. Those records describe an infestation and disturbed evidence; they do not prove that all stored material was damaged.
Whitmire used the joke that “The rats are the only ones enjoying it.” Reports also repeated the phrase “drug-addicted rats.” The available record supports rats accessing drug evidence, not clinical addiction, intoxication, or a scientific diagnosis in the animals.

How large was the storage problem?
The figures cited publicly refer to different inventories and dates. They should not be added together or treated as one snapshot.

ABC13 also reported evidence dating back to 1984. The age of an item alone does not determine whether it can legally be destroyed or whether it has no future evidentiary value.
What did Houston officials plan to do with old drug evidence?
Teare said the district attorney’s office had previously stopped police departments from destroying narcotics evidence held since 2005. On January 10, 2025, he announced a process to permit destruction of qualifying narcotics evidence obtained before 2015.

- Review cases and evidence: Prosecutors and police would identify items that met legal and case-related criteria.
- Obtain destruction orders: Eligible evidence would require the appropriate authorization rather than automatic disposal.
- Coordinate agencies: A senior attorney would work with HPD and other agencies.
- Address paperwork during pleas: The district attorney’s office said it would work to obtain destruction documentation during plea proceedings.
- Document approved disposal: Chief Diaz said evidence tags and barcodes would support accountability and that disposal would be documented.
Teare’s statement—“We will be destroying any narcotics evidence that has been obtained prior to 2015”—described the announced policy direction. It did not establish that every item from before 2015 qualified or that all planned destruction had been completed.
How evidence disposal is supposed to work
HPD’s Property & Detention Division describes its Property Storage Unit as the lead accountability agent for property and evidence management, preservation and control. Its disposition and disposal units work with prosecutors and courts to determine what may be processed, then dispose of approved property under state law and city ordinance.
That ordinary process matters because evidence is tied to specific cases, owners, legal orders and chain-of-custody records. A barcode or inventory entry shows that an item is tracked; it does not by itself prove that the item remained physically undamaged or that a court will find it admissible.

Could the rats affect criminal cases?
Potentially, yes—but the released accounts did not show that every case was affected or identify a universal legal result. ABC13 reported that prosecutors had to notify hundreds of defense attorneys about potentially compromised evidence. “Potentially” is important: a torn package, displaced item or possible contamination requires case-by-case review.
Questions investigators and courts may examine
- Whether the item was still needed for a pending prosecution, appeal or investigation.
- Whether its packaging, quantity, labeling or chain of custody was disturbed.
- Whether independent photographs, laboratory records, test results or witness testimony preserve some of its evidentiary value.
- Whether biological or other perishable material could have been contaminated or degraded.
- Whether the defense received notice and had an opportunity to challenge the evidence.
The materials reviewed here do not establish a particular dismissal, overturned conviction or other final outcome caused by the infestation.

Why not simply keep every piece of evidence?
Long-term retention protects the ability to retest evidence and answer later legal questions, but it also creates practical hazards. Peter Stout, president of the Houston Forensic Science Center, told The Washington Post: “They’re edible, they’re tasty, they’re all kinds of things. You can’t store large quantities of drugs without expecting some of these things to happen.” Large quantities consume space and can attract pests when facilities are not adequately protected.

University of Michigan law professor Richard D. Friedman told the same publication that, in his view, evidence should remain available while the person connected to the case is alive. That is an expert perspective, not a single nationwide rule requiring every item to be retained forever.

- that the animals consumed a specific drug or became intoxicated;
- that all 81,000-plus vault items were damaged;
- that every pending case involving vault evidence was compromised; or
- that the announced disposal program had been completed.
The latest details in the supplied record came from ABC13’s December 13, 2025 report on HPD-released materials. The reviewed sources do not verify the infestation’s present-day status or the final outcome of every affected case.
