That ruling removed the challenged circular, but it did not declare any breed inherently safe, decide the law in every other state, or prevent a later government measure.
What the Karnataka High Court decided
The headline that the court “stayed” the ban describes only the interim stage. The case’s reported final disposition was a judgment quashing the Union circular.

Accordingly, the March circular cannot be treated as an operative breed ban in Karnataka on the strength of that circular alone. A later notification, statute, court order or local rule could change the position, so owners and businesses should check current official records before acting.
What the Union circular attempted to prohibit
The circular classified the named breeds as “ferocious and dangerous to human life.” It sought to prohibit their import, breeding and sale as pets and for other purposes. It also called for dogs already kept as pets to be sterilised so that they could not be bred further.

The proposal covered mixed and cross breeds as well as dogs identified by the listed breed names. It therefore was not limited to importing a registered purebred animal or selling puppies from a particular kennel.

Why the court intervened
The court examined the process used to produce the Union measure. It recorded that the Delhi High Court direction underlying the action required consultation with all stakeholders, not merely selected participants.

The judgment records the observation: “The High Court of Delhi had clearly indicated that all the stakeholders shall be consulted, not a few or various. All means, each and every, the Kennel Club of India is one, which is not consulted is the submission.”
The record also noted the submission that declaring an entire breed inherently ferocious requires profound expertise. The court’s intervention was therefore about the consultation and evidentiary foundation for the circular. It was not a finding that Pitbulls, Rottweilers, Cane Corsos or any other listed dogs are safe, nor a ruling that individual dogs cannot be dangerous.

What the judgment means for different activities in Karnataka

Does this ruling apply outside Karnataka?
No. The interim stay expressly operated only in Karnataka, and the final judgment arose from a Karnataka petition challenging the circular. It does not, by itself, decide how authorities or courts elsewhere must treat the Union measure or any replacement policy.
Someone importing, breeding or selling a listed dog in another state must check that state’s current rules and any operative Union notification. The Karnataka judgment should not be presented as a nationwide invalidation of every possible restriction on these breeds.

How owners and businesses should check the current position
- Identify the exact rule. Ask whether an authority is relying on the 12 March 2024 circular, a later Union notification, a state enactment, municipal by-law or another order.
- Check the date and territory. Confirm that the document is current and applies in the Karnataka district where the dog, kennel, transaction or shipment is located.
- Keep records. Retain purchase or adoption documents, vaccination and registration records, microchip details where required, transport papers and any breed or cross-breed documentation.
- Separate breed rules from general duties. Leash, enclosure, nuisance, licensing, vaccination, bite-response and animal-welfare requirements can apply regardless of whether a breed-specific circular survives.
- Verify litigation and replacement policy. Because government policy and court proceedings can change, consult the latest Karnataka High Court docket and any replacement Union notification before importing, advertising a litter or completing a sale.
The bottom line
The Karnataka High Court’s March 2024 stay was a temporary, Karnataka-specific measure. Its 10 April 2024 judgment went further by quashing the Union circular challenged in W.P. 8409/2024. The court objected to the consultation and expertise supporting the classification; it did not certify any listed breed as safe. The circular’s proposed bans on import, breeding and sale—and its proposed sterilisation of already-owned dogs—therefore cannot be treated as operative in Karnataka without some separate, currently valid legal basis.
