Breed-Specific Legislation vs. Dangerous-Dog Laws: What U.S. Owners Need to Know

Breed-specific legislation regulates dogs by breed or appearance, while breed-neutral dangerous-dog laws look at an individual dog's conduct. Here is how they differ and what owners should check.

The core difference is the legal trigger. Breed-specific legislation (BSL) regulates or bans dogs because of their breed or appearance. Dangerous-dog laws, in their breed-neutral form, focus on what an individual dog did and the circumstances around it. Which rules apply to you depends on your state, county and city, so this is a general U.S. explainer and not legal advice for any one place.

The two approaches side by side

The ASPCA describes BSL as laws that regulate or prohibit dogs based on breed or physical appearance. It describes behavior-based dangerous-dog laws as rules that look at the individual dog’s conduct, and it recommends them in its policy statement on dangerous-dog laws. The table compares the approaches on the points that matter most to an owner.

Other points of comparison are whether the owner gets a hearing and appeal, who enforces the rule, and whether state law preempts local ordinances or lets them add their own. Jurisdiction decides all of these.

“Dangerous dog” is not one national definition

No single nationwide standard defines a dangerous dog. States write their own definitions, and many let cities and counties add to them. Two statutes show the range:

  • Florida: Chapter 767 of the 2025 Florida Statutes sets out dangerous-dog definitions. It also addresses what counts as a proper enclosure and allows local governments to impose additional requirements.
  • North Carolina: G.S. 67-4.1 defines “dangerous dog” through behavioral criteria and leaves the determination to local officials.

Treat neither as a national rule. A dog that meets the definition in one state may not meet it in the next.

What restrictions can follow a dangerous-dog finding

Conditions vary by statute and by written order. The ASPCA’s policy statement proposes a graduated model that can include:

  • behavioral evaluation or training
  • secure confinement
  • adult supervision
  • leash restraint
  • muzzling in public
  • microchipping

These are the ASPCA’s recommendations, not universal requirements. Your actual obligations are whatever the law and your order say.

Does BSL make communities safer?

The ASPCA’s position is that it is not aware of credible evidence that BSL makes communities safer. That is one organization’s stated view, not a finding established independently here. The ASPCA also raises concerns about enforcement, for example how a dog’s breed is identified.

In support of graduated, breed-neutral rules, the ASPCA cites Bradley (2006). That study reportedly found that repeat injurious bites in Multnomah County fell from 25 percent to seven percent under such an ordinance. This figure comes from the ASPCA’s position statement, and Bradley’s underlying work was not independently checked. It describes one county and does not show that the same effect would occur everywhere.

Due process: notice, hearing and appeal

The ASPCA’s policy supports giving owners a chance to be heard and to appeal a classification. Whether you have that right, and how fast you must act, comes from the law that applies to you. Deadlines can be short, so read any notice as soon as you get it.

What to do if you are affected

  1. Pin down the jurisdiction. Identify your state, county and city. Also check any housing or military-community rules that may add their own limits.
  2. Read the ordinance and the notice. Record the classification basis, the date, response deadlines, hearing details, appeal deadlines and any interim restrictions.
  3. Ask the animal-control agency what evidence supports the classification and how to contest it.
  4. Get local legal advice if the outcome could affect ownership, housing or the dog’s disposition.
  5. Confirm the exact standard before you buy equipment. A muzzle, leash, microchip or enclosure order may specify type and deadline. Florida’s statute, for instance, has its own idea of a proper enclosure, so a generic purchase may not comply.

Two assumptions to avoid

  • Appearance alone does not settle legal status. Whether a dog counts under a breed rule depends on the ordinance’s wording and how officials apply it.
  • A friendly temperament does not lift an existing restriction. Once a statute or order applies, it governs until it is changed or successfully challenged.
