Texas does not let counties or cities impose dangerous-dog restrictions that single out one breed or several breeds. That does not automatically prevent a landlord, homeowners association (HOA), or insurer from having its own breed-related rules. Those private rules depend on the lease, recorded covenants, applicable housing protections, and insurance policy—not just the state dangerous-dog law.
Are pit bulls or other breeds banned in Texas?
There is no statewide breed ban established by the Texas dangerous-dog statute. Texas Health and Safety Code Chapter 822 defines a dangerous dog by specified conduct and its consequences, not by breed. Section 822.047 also limits local government rules: a county or municipality may impose additional dangerous-dog requirements only if they are more stringent than the state rules and are not specific to one breed or several breeds.
The statute states: “A county or municipality may place additional requirements or restrictions on dangerous dogs if the requirements or restrictions: (1) are not specific to one breed or several breeds of dogs; and (2) are more stringent than restrictions provided by this subchapter.” This is a limit on government dangerous-dog regulation; it is not a blanket ban on breed-related rules in private leases, HOA covenants, or insurance policies.
Who can set a dog rule—and what does it apply to?
Start by identifying who made the rule. A city ordinance, a lease clause, an HOA declaration, and an insurance policy are different kinds of requirements, with different documents and processes to check.

Can an apartment in Texas ban a dog’s breed?
TexasLawHelp’s rental guidance says landlords can generally set pet rules in the lease, including allowing only certain breeds, requiring registration or a deposit, or prohibiting pets. The Texas Attorney General advises renters to read the rental agreement carefully and put agreed changes in writing with both parties initialing them. A violation of a lease pet rule can be grounds for eviction.
- Read the lease and every pet addendum for breed, size, registration, deposit, and approval terms.
- Ask the landlord or property manager for written approval before bringing the dog to the property.
- If the parties agree to change a rule, have the change documented in writing and signed or initialed as appropriate.
- If you receive a violation notice or face eviction, get advice promptly from a Texas tenant resource or attorney; do not assume that a city’s breed-neutral rule overrides a private lease clause.
Can an HOA restrict dog breeds in Texas?
HOA restrictions need a separate review from city or county ordinances. Texas Property Code Chapter 202 says discretionary action by a property owners’ association concerning restrictive covenants is presumed reasonable unless a court determines that the action was arbitrary, capricious, or discriminatory. That general provision does not resolve whether a particular breed restriction is enforceable.

Read the recorded declaration and any amendments, and consider whether a housing accommodation request applies. If the HOA threatens a fine or other enforcement, the wording of the covenant, the association’s action, and the facts of the dispute matter; a Texas attorney can assess the specific documents.
What makes a dog dangerous under Texas law?
Chapter 822’s dangerous-dog definition turns on specified unprovoked conduct and injury outcomes. The statutory routes include an unprovoked attack outside a secure enclosure that causes bodily injury, and an unprovoked attack causing serious bodily injury or death while the dog is outside its owner’s property. The dog’s breed alone is not the statutory trigger.

Whether a particular incident meets the definition depends on the statute’s exact language and facts, including the location, circumstances, injury, and any official determination. Do not treat an accusation or an informal description as a final legal determination; review the notice and current statutory text.
What happens if a dog is declared dangerous?
For an owner who learns that their dog is dangerous under Chapter 822, the statute generally requires action within 30 days. These requirements apply to a dog determined dangerous, not to every dog in Texas.

- Register the dog with the local animal-control authority.
- Keep the dog on a leash and under immediate control, or in a secure enclosure.
- Provide at least $100,000 in liability coverage or financial responsibility for bodily injury resulting from an attack.
- Follow applicable local requirements that meet the state-law limits.
An owner notified of a dangerous-dog determination may appeal within 15 days. Check the notice for the applicable procedure and deadline, and contact the local authority or a Texas attorney if you need to challenge a determination.

In covered housing, assistance animals are not treated as pets for pet-rule purposes. Texas housing-agency material summarizing HUD guidance says a provider may not reject an assistance animal solely because of its breed or size. A housing provider may still consider individualized evidence that the animal poses a direct threat or would cause substantial property damage, when that risk cannot be reduced through a reasonable accommodation. An accommodation may also apply to an HOA or land-use rule.
