If a hawk nest is near your home, leave it undisturbed and give the birds space. Keep children and pets away from the area, and do not approach, handle, or try to move the nest. If the nest creates a genuine safety problem or a hawk is injured, contact the appropriate local wildlife authority or a licensed wildlife rehabilitator.
How to stay safe near a hawk nest
Keep people and pets back
A hawk may defend its nest, particularly while eggs or young are present. Avoid repeated close approaches, keep children out of the nesting area, and supervise pets outdoors. Keep small pets leashed rather than letting them roam unsupervised.
If you must use a nearby walkway
Minimize the time spent close to the nest and avoid disturbing the birds. If a frequently used walkway passes beneath or near it, an overhead cover such as a portable canopy may help reduce exposure. The U.S. Fish and Wildlife Service recommends protective measures for walkways in areas where some nesting birds show aggression; follow local wildlife guidance before setting anything up.
Can you remove or move the nest?
Do not remove, damage, or relocate an active nest yourself. In the United States, most bird nests are protected under the Migratory Bird Treaty Act. U.S. Fish and Wildlife Service guidance says a nest containing eggs or chicks, or young birds still dependent on it, may not be destroyed without authorization. Permits for nest removal are generally limited to compelling circumstances, such as a human safety concern or danger to birds; state rules may also apply. Protection and permit rules depend on where you live, the species, and the circumstances. For example, North Carolina says native hawks are protected and active hawk nests with eggs or nestlings must not be harmed or destroyed. In the UK, it is an offence to intentionally take, damage, or destroy a nest while it is being used or built, with additional protection for certain listed species. Check current guidance from the wildlife authority in your jurisdiction before taking any action.
Who should you contact?
- Active safety conflict or questions about removal: Contact your local or state wildlife agency and ask for instructions about the nest and any legal options.
- Injured hawk: Contact a licensed wildlife rehabilitator. Do not try to capture or handle the bird; North Carolina’s wildlife agency provides this referral in its red-shouldered hawk guidance.
- No immediate hazard: Leave the nest alone and keep people and pets at a distance.
How long will the nest be a concern?
Nesting dates vary by species and location. The U.S. Fish and Wildlife Service describes an approximate January–August nesting-season period for some aggressive bird species, including several hawks; that range is not a universal calendar for every hawk or region. Do not use dates from another location as a biological or legal rule for your own nest. Ask your local wildlife agency for location-specific advice.

How to observe without disturbing the birds
If you want to check whether the nest is active, watch from a distance rather than approaching it. The U.S. Fish and Wildlife Service recommends binoculars for distant observation. They are optional; there is no need to buy equipment or get closer to follow the safety advice.
