How to Get a Service Dog Back After Someone Refuses to Return It

A service dog’s ADA status does not settle ownership. Learn how to document a refusal to return the dog, contact local authorities, and find jurisdiction-specific legal help.

If someone refuses to return your service dog, focus first on the dog’s safety, then document your ownership or custody claim and get advice about the process in your state. The ADA does not provide a general way to make a private person return a dog: service-animal access rights and ownership disputes are separate issues.

What to do first

  1. Check the dog’s safety and location. Find out whether the dog is in immediate danger or the person has threatened to move or harm it. If there is an emergency, contact emergency services or local animal control as appropriate. Do not trespass, threaten anyone, or try to take the dog by force; those steps can create separate safety and legal problems. If a court order or protective order may apply, get local legal advice before acting.
  2. Preserve relevant records. Save adoption, purchase, or transfer documents; licensing, vaccination, veterinary, and microchip records; photos; and messages about the dog’s possession or an agreement to return it. Keep original messages and note dates, names, and witnesses. Records from a service-dog program or trainer may document training and placement, but do not necessarily determine legal ownership.
  3. Make a clear written request, if it is safe. Calmly ask for the dog’s return, give a reasonable time, and suggest neutral logistics. Save the request and any refusal or conditions. Do not sign a transfer or surrender document without understanding its effect. A written demand is a practical way to document the dispute, not a federally required process.
  4. Ask local authorities how they handle the report. Contact your police department or sheriff and animal control, explain the facts accurately, and ask how the matter can be classified and documented. Whether authorities treat it as a criminal matter or a civil ownership dispute depends on the jurisdiction and facts; do not assume an officer can or will retrieve the dog.
  5. Contact local legal help promptly. Speak with a local attorney, legal aid office, disability-rights organization, or law-school clinic. Ask about a local return-of-property case—sometimes called replevin or claim-and-delivery—and whether temporary or emergency court relief is available if the dog faces imminent risk. The right claim, evidence, and filing deadline vary by state, so do not rely on a generic national filing recipe.

Does the ADA make someone return a service dog?

No general ADA rule gives a handler a way to recover a dog from a private person who refuses to return it. The U.S. Department of Justice explains that ADA service-animal rules principally concern access to places and services covered by Titles II and III, including public accommodations and state and local government entities. They do not decide a private ownership or possession dispute. DOJ’s Service Animals page and its Frequently Asked Questions about Service Animals and the ADA describe the access rules and their limits.

The ADA defines a service animal as a dog individually trained to do work or perform tasks for a person with a disability. Professional training, certification, registration, a vest, and special identification are not required for ADA public access. DOJ also says certificates sold as service-animal documents do not confer ADA rights and are not recognized as proof that a dog is a service animal. These documents and accessories do not, by themselves, prove ownership or compel someone to return a dog.

For public access, DOJ identifies narrow grounds for excluding a service dog, including when the dog is out of control and the handler does not take effective action, or when the dog is not housebroken. Those rules address access, not who owns a dog or who is entitled to possess it.

Keep a private return dispute separate from an access denial

If a covered business or state or local government entity is also denying access because of the dog, that may raise a separate ADA issue. DOJ says a person who believes a covered entity illegally denied access or service may file a complaint with the Department of Justice or bring a private federal ADA lawsuit. Those options concern the alleged access violation; they do not decide a separate dispute over the dog’s ownership or return.

Service-animal protections also arise under laws beyond the ADA in some settings. The DOJ Servicemembers and Veterans Initiative states that “The right for a person with a disability to live and travel with the aid of a service animal or assistance animal is protected by a combination of federal laws that vary based on factors like the type of animal and location.” Its Service Animals and Assistance Animals page was updated November 4, 2024. The applicable law depends on the setting; that broader protection does not create a general federal process for resolving a private custody dispute.

Why calling the dog a service dog does not settle the case

Service-dog status and legal ownership are different questions. Training records may help explain the dog’s role and placement, but ownership or a right to possession may depend on records, agreements, prior court orders, and state law. A vest or certificate is neither an ownership document nor a shortcut to recovery.

A July 3, 2019 order from the U.S. District Court for the Eastern District of Tennessee illustrates why invoking the ADA alone may not create a federal case. In that case, a plaintiff alleged that a former partner refused to return a dog described as a service dog. The court found no federal jurisdiction on the allegations presented: the complaint did not allege an ADA violation, and both parties lived in Tennessee, defeating the diversity basis asserted in the order. This was one district-court order, not a nationwide ruling that a service-dog dispute can never be heard in federal court. It does show that describing a dog as a service dog does not automatically establish an ADA claim or federal jurisdiction. The order is available through GovInfo.

What to ask a local attorney or legal-aid office

Bring your records and a concise timeline: when and how the other person got the dog, any agreement about the arrangement, when you asked for the dog back, and what response you received. Ask about:

  • Which person or organization has the strongest legal claim to ownership or possession under local law.
  • Whether an agreement, transfer document, or existing court order affects the dispute.
  • Which local procedure may apply to recover property, and what evidence and deadline it requires.
  • Whether the dog’s safety supports asking a court for temporary or emergency relief.
  • Whether police or animal control can lawfully intervene under local rules.
  • What steps are safe and lawful while the dispute is pending.

There is no state-neutral filing route or deadline that applies to every situation. Local counsel can assess the jurisdiction, documents, and urgency rather than assuming that the same claim or timetable works everywhere.
