To find out whether you can legally keep a reptile, identify its exact species and where it will live, then check the current rules at every relevant level: national, state, county, city, and property. Also verify the rules for the specific activity—keeping, buying, selling, breeding, transporting, or importing—because permission for one does not automatically cover the others. Check before acquiring the animal.
Start with the exact reptile and location
Write down the animal’s common name and, if you can confirm it, its scientific name. Common names can refer to different species, so ask the seller, breeder, rescue, or a qualified veterinarian for identification if you are unsure. Then identify the precise place where the reptile will be kept, including the state, county, and city or municipality.
In the United States, your state wildlife agency is a practical starting point. Look for its current species lists, prohibited or restricted wildlife rules, permit requirements, and ownership guidance. A general search result or a rule for a neighboring state is not enough to establish what applies to your address.
Check every authority that may set a rule
Federal and state rules
Review the current rules of the relevant federal and state agencies. Federal wildlife rules can affect import and certain movements of wildlife; state rules address possession and may regulate activity within the state. The U.S. Fish & Wildlife Service explains this division in its guidance on injurious wildlife regulations. It notes that “Possession of a species within State boundaries is also the responsibility of each State” in the context of those federal rules. That does not mean federal law never applies to reptiles.

County, city, and property rules
Check county and municipal ordinances as well as any rules that apply to the specific property, such as a lease, homeowners association, or housing policy. The CDC advises: “Check state, local, and property laws before selecting or purchasing a reptile or amphibian.” See its reptile and amphibian guidance.
Check the rule for the activity you plan
Search for the rules that apply to each activity you intend to carry out. Do not assume that permission to keep a reptile also permits you to acquire, sell, breed, exhibit, transport, or import it.

- Possession: Can you keep this species at your location?
- Acquisition: May you buy, adopt, or otherwise obtain it there?
- Sale or transfer: Are there restrictions on selling, giving away, or transferring the animal?
- Breeding or exhibition: Do these activities require separate authorization?
- Transport: Are there limits on moving the animal within or between jurisdictions?
- Import: Do additional federal, state, or carrier requirements apply if it is coming from another country?
Look for permits, identification, and exceptions
Read the rule for requirements such as a permit, registration, microchip or other identification, inspection, or a grandfathering provision for animals already owned. Check who may qualify, what activity the authorization covers, and when it must be obtained. A permit is not blanket permission: the U.S. Fish & Wildlife Service says a valid permit must be obtained before beginning an activity that requires one. Its permit information can help you identify federal permit requirements.
Rules can be species-specific and may have limited exceptions. Florida, for example, publishes prohibited-species information and restrictions on personal pets alongside limited permit or legacy exceptions. Consult the current Florida Fish and Wildlife Conservation Commission rules if the animal will be kept in Florida; those provisions do not establish the rules for other states.

If you plan to import a reptile, make a separate check
Crossing an international border can trigger requirements beyond the rules for keeping the animal at its destination. Check federal wildlife and animal-health requirements, the destination state’s agriculture rules, and the carrier’s policies. The USDA Animal and Plant Health Inspection Service directs importers to consider these separate requirements in its pet travel guidance. Protected wildlife may also require U.S. Fish & Wildlife Service permits and compliance with treaty rules such as CITES; consult the agency’s international wildlife trade information.

- Contact the agency responsible for the rule, such as the state wildlife agency or local animal-control office.
- Provide the exact species name, the county or address where it will be kept, and the activity you plan.
- Say whether you already own the reptile or are considering acquiring it. Existing ownership may matter if an exception or transition rule applies.
- Ask which current statute, regulation, ordinance, permit condition, or policy controls and whether any additional approval is required.
- Save the agency’s response and the official rule or ordinance you consulted.
Rules and agency guidance can change, so confirm the current official text before acting. This process can help you verify the requirements for your circumstances, but it is not a determination that a particular reptile is legal at every address.
