Possibly, but there is no universal rule that guarantees a dog’s return after someone else surrenders her. The answer depends on where you are, how the rescue took custody, whether the person who delivered your dog had authority to surrender her, what the records show, and whether she has already been placed. Contact the rescue promptly, make your ownership claim in writing, and ask for a temporary hold while the dispute is reviewed.
What should I do first?
- Contact the rescue. Ask whether your dog is at the facility, in foster care, transferred, or adopted. Explain that you claim ownership and did not authorize a permanent surrender. Request a temporary hold on placement while the dispute is reviewed.
- Send a written notice. State that you dispute the surrender and ask for the surrender or release form, intake notes, microchip scan and contact attempts, any transfer records, and the identity of the person who delivered the dog and the authority they claimed. Whether the rescue must provide these records depends on local law and its policies.
- Contact local animal control or the relevant shelter regulator. Ask how the dog was recorded—owner surrender, stray, or official seizure—and which local process and deadlines apply. Do not assume that a deadline for stray dogs applies to a voluntary surrender.
- Get local legal advice promptly if placement is imminent or the rescue will not pause it. Ask a lawyer or legal aid service about the appropriate return demand or court process in your jurisdiction. Do not trespass, threaten anyone, or try to take the dog yourself.
Why does the way the rescue got my dog matter?
Owner surrenders, stray intakes, and official seizures can follow different rules. The examples below are specific to the named jurisdictions and procedures; they do not establish a general rule for every rescue or location.

What proof can help show the dog is yours?
Gather records that connect you to the dog and show ongoing care. Keep copies and note when each document was created; no single item is guaranteed to settle a disputed ownership claim.
- Microchip number and registration details, including any contact information or change history you can access.
- Dog license or registration, adoption or purchase paperwork, and veterinary records.
- Rabies certificate and dated photographs that identify the dog or show her with you over time.
- Messages, receipts, or other records showing you arranged or paid for her care.
For impounded dogs, New Jersey Department of Health guidance lists a valid license, registration, rabies inoculation certificate, and documentation from the owner’s regular veterinarian as examples of proof that may be used to reclaim a dog. That guidance is specific to New Jersey impoundments; the records requested elsewhere can differ.

Can the rescue adopt my dog out after someone else surrendered her?
There is no single answer that applies to every jurisdiction or custody situation. Relevant facts include whether the person who signed was an owner or had authority from an owner, what the surrender paperwork says, whether identification was scanned and contact attempts were made, and whether the dog remains with the rescue or has been transferred or adopted. Those facts and the applicable local process can affect what options are available; the examples above do not decide an individual case.
If the rescue says the dog has already been placed, ask for the date and type of transfer and take that information to a local lawyer or legal aid service promptly. A lawyer can assess the records and advise whether an urgent demand or court filing is appropriate.
