Service Dog vs. Emotional Support Animal: Rights, Training, and Access in the U.S.

Service dogs and emotional support animals have different rights depending on the setting. Compare U.S. rules for public access, housing, air travel, training, and equipment.

The key difference is a trained disability-related task versus comfort from an animal’s presence—but the legal answer depends on where you are. U.S. public access is generally governed by the Americans with Disabilities Act (ADA), housing by the Fair Housing Act (FHA), and air travel by the Air Carrier Access Act (ACAA) and Department of Transportation (DOT) rules. State and local laws may provide different or additional protections.

How do service dogs and emotional support animals differ?

Under the ADA rules for public accommodations and state and local government services, a service animal is generally a dog individually trained to do work or perform tasks for a person with a disability. The task must be directly related to the disability. As the U.S. Department of Justice (DOJ) puts it in ADA Requirements: Service Animals, “The work or task a dog has been trained to provide must be directly related to the person’s disability.”

An animal whose presence provides comfort or emotional support, without a trained disability-related task, is not an ADA service animal for ordinary public-access purposes. That does not mean an emotional support animal (ESA) has no legal recognition: housing law uses a broader assistance-animal framework, and air-travel rules use their own definitions.

Psychiatric disabilities can qualify. For example, a dog trained to detect an impending anxiety episode and take a specific action to help may meet the ADA definition. A dog that is comforting simply by being present does not qualify as a service animal on that basis. DOJ examples of tasks also include reminding a person to take medication, retrieving items, guiding or alerting, and assisting during a seizure.

Which rules apply in public, housing, and air travel?

Setting Governing framework How the animal is treated
Businesses and government services open to the public ADA Titles II and III Generally covers a dog trained to perform disability-related work or tasks; comfort from presence alone is not enough.
Housing Fair Housing Act (FHA) May cover an assistance animal that works, assists, performs tasks, or provides emotional support that alleviates identified effects of a disability.
Air travel Air Carrier Access Act and DOT rules For the service-animal category, covers a dog individually trained to perform work or tasks for a qualified person with a disability; excludes ESAs.

These are federal frameworks; the details below describe the federal guidance cited by DOJ, the U.S. Department of Housing and Urban Development (HUD), and DOT. The ADA pages cited here were last updated in 2020. DOT’s service-animal page reports an update on September 25, 2025. Agency guidance is useful but not a substitute for the governing statutes, regulations, and binding judicial precedent.

What access does an ADA service dog have in public?

State and local government entities, businesses, and nonprofits serving the public generally must allow a service dog anywhere members of the public may go, even if pets are not allowed. This typically includes restaurants, shops, and most public hospital spaces. A limited, area-specific exclusion may be justified when the dog’s presence would compromise a legitimate safety requirement—for example, in a sterile operating room.

When may a business exclude a dog?

An individual dog may be excluded if it is out of control and the handler does not take effective action, or if it is not housebroken. A direct-threat decision must be based on the particular dog’s actual behavior or history, not a breed stereotype, fear, or allergies alone. If a dog is properly excluded, the person must still be offered the goods or services without it.

What may staff ask?

When the dog’s role is not obvious, staff may ask only:

  1. Is the dog required because of a disability?
  2. What work or task has the dog been trained to perform?

They may not ask the person to disclose the nature of the disability, demand medical or training documents or an ID card, or require the dog to demonstrate its task.

Can a venue charge a service-dog fee?

Covered entities generally cannot add a pet fee, surcharge, or cleaning fee for a service dog. They may charge the same fee for damage that they would charge any other customer. The handler remains responsible for the dog’s care and supervision.

Can an ESA qualify for a housing accommodation?

Housing is different from public access. Under HUD’s FHA materials, an “assistance animal” is a broader category that includes an animal that works, assists, or performs tasks, as well as an animal whose emotional support alleviates one or more identified effects of a person’s disability. For this accommodation analysis, assistance animals are not treated as pets.

A person may request an accommodation to keep an assistance animal despite a no-pets rule, or to waive a pet deposit or fee. HUD says a housing provider must allow an accommodation when the request is made by or for a person with a disability, any requested reliable disability-related information is supplied when the disability or need is not apparent, and the provider has not established a recognized basis to deny the request.

HUD describes potential grounds for denial that include an undue financial and administrative burden, a fundamental alteration, an unmitigable direct threat, or significant physical damage that cannot be reduced by another reasonable accommodation. An online ESA certificate does not by itself establish entitlement; the relevant question is whether the request meets the applicable disability-related and accommodation criteria.

Can an ESA fly as a service animal?

No. DOT’s ACAA guidance excludes emotional-support, comfort, and companionship animals from the service-animal category. It also excludes species other than dogs and animals still in training. The DOT definition covers a dog individually trained to do work or perform tasks for a qualified person with a disability.

An airline may require the DOT service-animal air-transport form, which attests to the dog’s health, behavior, and training. For a flight of eight hours or more, it may also require the relief attestation. DOT guidance describes possible grounds for refusing transport, including a dog too large to be safely accommodated, a direct threat, significant disruptive behavior, or a health restriction affecting entry into a U.S. territory or foreign country.

Before departure, check DOT guidance and the airline’s current instructions because forms and procedures can change. If a dispute arises, DOT directs passengers to request the airline’s Complaints Resolution Official (CRO).

Does a service dog need professional training, a vest, or certification?

The ADA requires disability-related task training, but not professional training. A person with a disability may train their own dog; federal ADA law does not mandate a particular training route. The dog must already be trained to perform its task to qualify under the ADA, so dogs in training are not covered by the federal ADA public-access rule. State or local laws may cover dogs in training differently. Ordinary dog licensing and vaccination rules still apply.

The ADA also does not require a formal certification, registration, vest, or special identification. Online certificates and registration papers do not create ADA access rights. A vest or leash can be a practical handling choice, not proof of legal status.

A leash, harness, or tether is generally required in public. An exception applies if the handler’s disability prevents using one or the device interferes with safe, effective task performance; in that case, the handler must maintain control through voice, signals, or another effective means. Choose equipment for the task and handler’s control needs, not in expectation that a purchase will confer service-animal status.

How should you decide which route fits?

  • For public access: Ask whether a dog has learned a specific task directly related to a disability. Comfort from presence alone does not meet the ADA service-animal definition.
  • For housing: Consider whether an assistance animal is needed because of a disability-related effect and whether the request meets HUD’s accommodation criteria.
  • For air travel: Use DOT’s service-animal rules; an ESA does not qualify in that category.
  • For training: Compare owner-training and professional assistance by the handler’s needs, available support, and practical circumstances. The ADA does not require professional training.
  • For equipment: Choose what supports safe handling and task performance. Equipment, registration, and certificates do not establish ADA status.
  • For state or local protections: Check the rules where you live or plan to go; they may differ from or add to the federal protections described here.
