How to Check Whether Your Dog Is Classified as a Restricted Breed

A restricted-breed label depends on where you live, which rule applies, and whether an official notice exists. Here is how to check each one.

You cannot tell whether a dog is a restricted breed from its name, its looks, or a breed label on paperwork alone. The answer depends on where the dog lives, which rule is being applied, and whether an official authority has already made a decision about this particular dog. The fastest route is to identify the rule-maker with jurisdiction, ask for its written definition, and ask whether a formal notice or record exists for your dog.

Start by identifying which rule applies

“Restricted breed” is not one universal legal category. People use the phrase for at least three different kinds of rule, and each has its own source, test and review process. Before you check anything, decide which of these you are dealing with.

A dog can be fine under animal-control law and still be refused by a landlord, or the reverse. Treat each track separately.

Step-by-step check

  1. Confirm the exact location. Use the dog’s current address, not the address on an old registration or the owner’s home country. Identify the council, animal-control authority or other agency with jurisdiction. A breed list from another city, state or country does not apply.
  2. Get the current written rule. Check the authority’s official website for restricted or banned breed rules, local ordinances, definitions and forms. Then ask in writing whether the rule covers a named breed, cross-breeds, appearance, behaviour, or an individual declaration.
  3. Ask whether a formal notice already exists. Ask whether the dog has been formally declared or recorded as restricted, who made that decision, what evidence or assessment was used, and when and how any notice was served. Keep copies of the notice and every related dog record.
  4. Find the stated review route and deadline. Some places specify an approved breed assessor, a tribunal appeal or another review. Follow the deadline printed on the notice. Do not assume another jurisdiction’s timetable applies.
  5. Check private rules separately. For a lease, strata policy or insurance policy, request the current written pet or breed terms. Ask the body to identify the specific clause and to say whether it concerns the dog’s legal status or the organisation’s own policy.
  6. Ask the decision-maker what evidence it accepts. If the status is unclear, contact the authority before paying for any assessment or test, and ask what it will rely on.

How the rules differ between places

Official systems vary widely, which is why the location must come first. The examples below show the range. They are illustrations of how particular jurisdictions work, not rules for your dog.

Tasmania

Tasmania separates dogs declared dangerous because of their behaviour from restricted-breed dogs designated by breed. It names five breeds. Councils and veterinarians use identification guidelines when deciding breed. After a formal declaration notice, the owner has 28 days to appeal to the Tasmanian Civil and Administrative Tribunal (Tasmania Department of Justice, 2026).

New South Wales

New South Wales covers named dog types and dogs that a council has declared restricted. After a notice of intention, the owner has 28 days to object (NSW Office of Local Government, 2024). The owner may then seek a certificate from an approved breed assessor. For a cross-breed, a temperament assessor route may be available. Whether it applies depends on the notice and the council.

England and Wales

GOV.UK states the test plainly: “Whether your dog is a banned type depends on what it looks like, rather than its breed or name.” The owner is responsible for proving that the dog is not a banned type. A pedigree, a shelter label or a breed certificate does not settle the question by itself.

Washington and South Dakota

These two US states take opposite approaches to local rules. Washington law generally restricts local breed-based bans and requirements, subject to statutory conditions. South Dakota prohibits local enactments that are specific to a breed or a perceived breed. In both states, local ordinances must be read against state law, so check what a city or county can and cannot do before relying on its breed list.

Victoria

Victoria’s guidance refers to an authorised officer taking DNA samples in a suspected-breeding context. That is an enforcement step taken by an officer, not a test an owner orders to establish classification.

Breed label, appearance and DNA results

A breed label on a registration or shelter record is evidence of what someone believed at one time. It is not automatically a legal determination. Keep these points in mind:

  • Some official schemes list named breeds, some include cross-breeds, some test appearance, and some depend on a formal decision for the individual dog.
  • A visual judgement by a vet, shelter worker or neighbour is not a legal finding, even when it is accurate.

Private rules: leases, strata and insurance

Landlords and tenants should check local council laws as part of any rental pet decision, according to NSW Fair Trading. That check is separate from what a lease says. Insurance is a further track. In Illinois, state law bars specified actions on homeowner and renter policies based solely on a dog’s breed or mix for covered policies. It keeps an exception for a dog individually determined to be dangerous or vicious under state law. Those Illinois terms do not carry over to other states or countries, so read the actual policy wording and ask the insurer which clause it is relying on.

Notices, deadlines and what to do next

Treat any official notice as time-sensitive, and act on it before doing anything else. Deadlines are set by the jurisdiction and the notice, so confirm them with the authority named on the document.

  1. Read the notice for the decision, the date it was served, and the deadline to object or appeal.
  2. Write down the exact route the notice names, such as an approved breed assessor or a tribunal appeal.
  3. Request the evidence the authority relied on, along with the dog’s records.
  4. If you miss a deadline or the route is unclear, ask the authority in writing what options remain, and consider advice from a local animal-law adviser.

What to send when you ask for a determination

A written request gets a clearer answer. Include your address, the dog’s age and sex, any registration or microchip details, a copy of any notice or letter you have received, and your question in one sentence. Ask for three things in writing: the definition used, the evidence the decision-maker accepts, and the review route.
