A denied child-adoption application usually means the deciding agency or adjudicator found an eligibility, safety, readiness, or documentation concern. It does not automatically mean every adoption route is closed or that you are permanently unable to adopt. First identify who made the decision and at what stage, then obtain the reasons and review instructions in writing. Deadlines, terminology, and rights vary by state, agency, adoption pathway, and— for intercountry cases—whether the decision came from U.S. Citizenship and Immigration Services (USCIS).
Start by identifying exactly what was denied
“Adoption denied” can describe several different decisions. A public child-welfare agency may reject an initial application or approve a home study but decline a particular placement. A private placement agency may use its own screening and reconsideration process. A court may make a placement or finalization decision. In an intercountry case, USCIS separately decides whether prospective parents are suitable and eligible to bring a child to the United States.

Read the notice for the decision-maker, date, stage, and stated outcome. Those details determine which rules apply and whether a review route exists.

| Public child-welfare agency | An application, home study, or child-specific placement was not approved under state or agency standards. | The written findings, agency-review contact, and any statutory deadline. |
| Private placement agency | The provider decided that it cannot accept or place the applicant under its program rules. | The agency’s reconsideration, grievance, or appeal procedure and the records it will release. |
| Court | A judicial decision affected placement, consent, or another legal step. | The order, service deadline, and advice from a lawyer licensed in that jurisdiction. |
| USCIS in an intercountry case | The federal suitability application was not approved, regardless of a state home-study result. | The written USCIS reasons and any federal filing or motion instructions in the notice. |
Do not assume that an unfavorable home study is the same as a USCIS denial, or that an agency’s decision controls every other agency. Each decision-maker applies a particular process.

Why adoption applications are commonly denied
State examples show recurring concern areas, but they are not a nationwide checklist. North Carolina and Iowa describe factors agencies may document when evaluating applicants; USCIS lists specific grounds for its federal suitability decision. A conviction, diagnosis, financial problem, or relationship issue is not an automatic disqualification everywhere.
Child-safety and child-welfare history
Agencies may examine substantiated or founded child-abuse or neglect records. North Carolina and Iowa materials include abuse and neglect findings among issues that can affect an assessment, with evaluation provisions in some circumstances. The question may involve the facts, recency, severity, and relevance to the child’s needs rather than the existence of a record alone.
USCIS’s intercountry suitability process identifies concealed or misrepresented arrest, conviction, substance-abuse, sexual-abuse, child-abuse, family-violence, or other offender history as possible denial grounds. Failure to cooperate with required child-abuse registry checks can also matter. Read the notice carefully: it may concern nondisclosure, an underlying event, or both.
Criminal history or an eligibility requirement
Criminal-history checks are part of many adoption assessments. North Carolina and Iowa identify convictions as relevant while allowing for evaluation under their respective rules. USCIS may deny when a federal eligibility requirement is unmet or when specified history was concealed or misrepresented. Do not infer from another state’s rule that your record has the same effect in your case.

Ask the agency to identify the exact record and rule it relied on. If the record is inaccurate, incomplete, sealed, expunged, or belongs to someone else, ask what procedure exists to correct it and what certified documentation is required.
Capacity to parent and readiness to meet a child’s needs
Assessors consider whether a proposed parent can provide proper care. North Carolina lists documented concerns such as motivation, child-rearing ability and practices, and emotional stability. Iowa’s examples also include health, relationships, finances, and the marital relationship. These factors are assessed in context, including the needs of the child being considered.
A concern may involve unrealistic expectations, inability to describe needed support, conflict between household members, or a plan that does not address a child’s medical, developmental, behavioral, cultural, or educational needs. A child-specific mismatch is an assessment of suitability for that situation, not necessarily a finding that a person is categorically unfit to parent.
Physical or emotional health
Health information can be relevant when it affects the ability to provide safe, consistent care. Iowa identifies health and emotional or physical concerns among possible documented issues, and North Carolina identifies emotional stability. The decision should be tied to the applicable standard and evidence, not a broad assumption based only on a diagnosis or treatment history. Request the specific finding and ask whether updated medical information or a professional assessment is accepted under local rules.

Substance use
Iowa’s rule includes verified substance use or abuse that prevents adequate care. USCIS also lists certain concealed or misrepresented substance-abuse history in its suitability grounds. If the notice cites substance use, determine whether the concern is current impairment, a past event, failure to disclose, an unresolved treatment recommendation, or a combination. Respond only with accurate records and ask what assessment or documentation the governing process permits.
Finances, relationships, and household stability
Financial resources and relationships can affect the safety and stability of a placement. Iowa specifically lists finances, relationships, and the marital relationship among possible documented concerns. An agency may ask how the household will manage ordinary expenses, adoption-related costs, leave from work, child care, or a child’s additional services. It may also evaluate household conflict, separation, or whether all adults understand and support the plan.
Missing information or failure to cooperate
Applications can fail because required information was not supplied or because an applicant did not cooperate with the assessment. Iowa identifies failure to cooperate in providing information. USCIS cites failure to cooperate with child-abuse registry checks and failure to disclose prior home studies in its specific process. A missed form, unanswered request, or incomplete disclosure can therefore become a separate concern from the underlying history.
What to do immediately after a denial
- Record the date you received the notice. Keep the envelope, email, portal timestamp, and every attachment. The date may control a review or appeal deadline.
- Identify the decision and stage. Note whether the notice concerns an initial application, home study, child-specific placement, post-placement step, court action, or USCIS suitability determination. Write down the agency, office, and named contact.
- Request the complete reasons in writing. Ask for each finding, the evidence or document relied on, and the rule, regulation, or policy supporting it. Ask whether the decision is final or whether reconsideration, agency review, a grievance, an appeal, or another process is available.
- Request the procedure and deadline. Ask where to file, the required format, the filing date, and whether the process stays the decision. Never substitute another state’s timeline for the one in your notice.
- Preserve your file. Save the application, home-study report, releases, background-check results, medical and financial records, training certificates, correspondence, and notes of calls. Ask how to inspect or correct records when local law permits.
- Address only the stated issues. If the notice identifies a factual error, missing record, or changed circumstance, provide a concise correction with reliable documentation. Ask whether supplemental material or a reassessment is accepted; an agency is not necessarily required to reopen a denial.
- Get local help quickly. Contact the supervisor or review office named in the notice. Consider an adoption attorney licensed where the decision was made, particularly if a child is already placed in your home, a court case is pending, the case is intercountry, or the filing period is short.
Can you appeal an adoption home-study denial?
There is no universal appeal right or standard deadline. The following examples illustrate how narrow and jurisdiction-specific review rights can be.

| Jurisdiction or process | Documented example | Important limit |
|---|---|---|
| Ohio | Ohio Revised Code § 3107.033 directs adoption home-study rules to include a procedure to appeal an application denial resulting from a search of the uniform statewide automated child-welfare information system to the agency that employed the assessor. | This provision addresses that defined database-search denial, not every Ohio adoption denial. |
| Maryland | The cited COMAR provision says a private child-placement agency must explain the denial reason and appeal process and provides reconsideration under its stated rules. | Confirm that the current provision applies to your agency and decision. |
| North Carolina | The September 2025 state manual says an applicant who is not accepted must receive the reason in writing and have a right to agency review of the summary; it also calls for written notice of approval or denial after the study. | The manual’s process is state-specific and does not set another jurisdiction’s rights. |
| Nevada | In the cited child-welfare context, prospective adoptive parents may review and respond to an unfavorable home-study result before results are issued, subject to the statute. | Do not extend this opportunity automatically to other states, agencies, or pathways. |
| USCIS intercountry suitability | USCIS says an officer who cannot approve the suitability application must explain the specific reasons for denial in writing. | Federal instructions and filing options in the notice govern; a state agency review does not replace the federal process. |
Ask for the current rule or policy in effect for your case. A general agency conversation may be available even when no formal appeal is listed, but do not treat an informal discussion as a legal extension of a deadline.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone.Intercountry adoption: keep the state and federal decisions separate
The U.S. Department of State explains that a home study is required for USCIS to decide whether prospective parents are suitable and eligible to adopt abroad and bring a child to the United States. Federal requirements apply, while state preparation requirements vary.
USCIS makes an independent adjudication. Its stated denial grounds include unmet eligibility requirements; lack of satisfaction that proper care will be provided; certain concealed or misrepresented histories; failure to cooperate with child-abuse registry checks; and failure to disclose prior home studies. USCIS requires the officer to explain specific denial reasons in writing when the suitability application cannot be approved. A favorable state home study therefore does not guarantee federal approval, and a federal denial should be answered through the federal process described in the notice.

Seek review when the notice contains an error
Review is most useful when the agency relied on an incorrect identity match, outdated record, missing document, misunderstood household fact, or misapplied rule. Gather the primary records and explain precisely what is wrong. Do not bury the correction in a general narrative about your desire to adopt.

Ask about reassessment after a genuine change
If the concern involves treatment, training, finances, housing, relationship stability, or a support plan, ask what evidence the agency would consider and whether a new assessment is permitted. Get the required steps in writing. A changed circumstance may support a new review, but it does not guarantee approval.
Reapply only after learning the agency’s requirements
Some programs may permit a later application; others may require a waiting period, additional training, updated clearances, treatment documentation, or a different pathway. Ask what must change before reapplying, whether the prior file will be considered, and which documents expire. Make a realistic plan rather than submitting the same incomplete application again.
Questions to send the deciding agency
- What exact decision was made, by whom, and on what date?
- Is this a denial of my application, an unfavorable home study, a decision about a particular child, or a federal suitability denial?
- What specific facts and documents support each finding?
- Which rule, regulation, policy, or program standard was applied?
- Is the decision final, and is reconsideration, review, grievance, appeal, or court review available?
- What is the filing deadline, delivery method, and required form?
- May I inspect or correct records, and will you accept supplemental evidence?
- If reapplication is possible, what must be completed or changed first?
A denial is a decision within a particular process, not a single nationwide judgment about adoption ability. The most useful next step is to match the written reason to the correct review route, preserve the deadline, and respond with accurate evidence under the rules that actually govern your case.
