Dangerous Dog Laws in the U.S.: Keeping People and Pets Safe

Dangerous dog laws vary by state and locality. Here is how designation usually works, what owners may be required to do, how appeals differ, and how to keep people and pets safe.

There is no single dangerous-dog law in the United States. Whether a dog is labeled dangerous, what the owner must do afterward, and how the label can be challenged are set by state and local law and by the written order issued in the case. Florida, Ohio, the District of Columbia, and North Carolina handle these questions differently on the points that matter most, so the answer depends on where the dog is kept. This guide explains the common sequence, compares the official examples, and covers what keeps people and pets safe while a case is pending or after a designation.

How a dog is usually designated dangerous

Most dangerous-dog regimes follow the same general path: a complaint or incident report, an investigation, and a determination made through an administrative or judicial process. The details are set by local law. The examples covered here do not establish that every jurisdiction uses the same hearing officer, evidence standard, appeal route, or timetable.

Florida’s 2026 statute (Florida Statutes §767.12) directs an animal-control authority to investigate reported incidents and describes hearing and appeal steps. Read as a sequence, the Florida text follows this pattern:

  1. A report is made. A complaint or incident report reaches the local animal-control authority.
  2. The authority investigates. Under the Florida statute, investigating reported incidents is the authority’s responsibility.
  3. A hearing takes place. The Florida statute describes hearing steps in the classification process.
  4. A written final order issues. The Florida statute provides for a written final order, which the owner should treat as the controlling document for that case.

AVMA’s 2001 model legislation, published with its guidance ‘A community approach to dog bite prevention,’ also describes a hearing and judicial review. It is a model, not enacted law, so it shows what a process can look like rather than what any particular city or state requires.

What a designated owner may have to do

After a designation, the official examples impose duties such as registration, secure confinement, restraint on a leash, muzzling in specified circumstances, and insurance. The table compares what each cited text covers. ‘Not stated’ means the provision examined does not address that duty. It does not mean the duty can never apply in that place, because local ordinances and orders may add conditions.

These examples are not interchangeable. Check the current official text for your state and locality, the dog’s classification, and the terms of the order. The examples do not establish a standard leash length, and they do not support telling every owner to buy insurance. Insurance and similar duties apply where the law or the order requires them.

Appeals and deadlines

What Florida provides

Florida’s statute provides for a written final order and an appeal to circuit court under the applicable appellate rules. It also addresses confinement pending appeal. These are Florida-specific features and should not be assumed elsewhere.

What is common and what is not

AVMA’s model legislation describes hearing and judicial-review concepts. Because it is a model, it does not establish a uniform U.S. appeal process, and the official examples covered here do not show one either.

Why deadlines cannot be generalized

No single national deadline for a hearing or appeal can be given. The deadline comes from the jurisdiction that issued the notice, so work from the date stated in that notice or order, or the date the issuing authority confirms in writing. A deadline found in a general online guide is not a substitute.

Breed and conduct: what triggers a designation

Breed alone does not define a dangerous dog across the United States. AVMA’s model legislation says breed should not be considered within that model, but that is guidance, not binding law. Each statute or ordinance sets its own triggers and may include exceptions or defenses. The triggering conduct is defined in the local text, so compare it with the incident described in your notice rather than relying on a general description of what counts as dangerous.

Keeping people and pets safe around a dog that has bitten

Safety planning should fit the individual dog and the terms of the order. The measures below reflect the restraint, confinement, supervision, and behavior-support themes in AVMA’s prevention guidance and in the official examples.

  • Reliable restraint: control the dog with a leash or tether whenever it leaves a secure space, and use a muzzle wherever the order or statute requires one.
  • Secure barriers: keep the dog confined in a way that keeps it, and visitors and children, apart, and meet any enclosure specification in the order.
  • Adult supervision: have an adult present around visitors and children, particularly when the dog is out of confinement.
  • Behavior and veterinary support: work with a veterinary behaviorist or qualified dog-behavior professional, as AVMA’s guidance suggests, and keep the dog’s veterinary care current.

No single product, training method, or breed label guarantees safety. Muzzles, leashes, and enclosures matter because specific laws require them, but generic gear does not automatically meet a local specification. The statutes examined do not establish that any particular muzzle style, including basket-style muzzles, satisfies every order, so check the order’s wording and the fit and use it requires before buying.

Checklist when a notice or order arrives

  1. Keep the written notice or order, and record the date you received it.
  2. Identify the statute or ordinance it cites, and find the current official text.
  3. Ask the local animal-control authority, in writing, for the next deadline and the hearing or appeal steps that apply.
  4. List every condition in the order, such as registration, enclosure, muzzle, leash, insurance, or reporting, and confirm which ones apply to your dog.
  5. If you contest the designation, ask whether confinement is required while an appeal is pending.
  6. Consult a local attorney before the deadline if you plan to challenge the designation.
