In April 2006, Dana and Gary Ganyer sued a Pennsylvania veterinary clinic, alleging that their German shepherd, Annie, had been sedated and transferred to another owner instead of euthanized. The contemporaneous reports describe allegations in a civil case—not a court finding that the clinic or its employees faked the dog’s death.
What the Ganyers alleged
The lawsuit concerned Annie, a two-year-old German shepherd whose seizures had become increasingly frequent and debilitating, according to Associated Press reporting. The Ganyers said they had researched the decision and spent weeks wrestling with it before deciding on euthanasia.
The filing alleged that in February 2005, at Mill Pond Veterinary Clinic in Milford, Pennsylvania, Annie was given a sedative rather than euthanized, then given to another owner. The AP account does not independently establish that this happened. The AP report carried by Fox News and the AP report republished by News-Times describe the same filing-era account.
How the Ganyers said they learned Annie was alive
The Ganyers reportedly said a former clinic employee called them on June 30 and told them Annie was still alive. The report does not specify the year for that date. A few days later, they visited Gene Rizzo, whom the AP identified as Annie’s new owner. The Ganyers said Annie was rightfully theirs; Rizzo reportedly refused to return her.

Dana Ganyer told the AP: “When I heard she was still alive I literally screamed and went into hysterics and I was in shock for three days.” That is her account as a party to the lawsuit, not independent confirmation of the allegation.
Who was named in the lawsuit, and what did it seek?
According to the contemporaneous report, the defendants included Mill Pond Veterinary Clinic, Mill Pond Kennels and three employees. The lawsuit reportedly alleged fraud, negligence and defamation and sought unspecified damages. These were claims in a civil filing; the report does not say a court found the defendants liable.

What the report said happened to Annie afterward
The AP reported that Rizzo said Annie continued to have seizures every few weeks but was otherwise “perfectly normal.” It also reported that Annie was euthanized on November 2 after Rizzo said she had been in a coma-like state for two days and his veterinarian told him she was “really suffering.” The report does not state the year for that November 2 date.

The available contemporaneous coverage establishes that the Ganyers filed a lawsuit in Bucks County in April 2006 and describes the allegations made in it. It does not establish whether the case was resolved by judgment or settlement, or whether any veterinary licensing action followed. The AP story says a lawyer for the clinic did not return a call; that is not a substantive response to the allegations.
