Western Australia is drafting amendments intended to let local councils make cat-containment laws, but the government sources available as of 4 October 2026 do not establish that the changes have passed or commenced. The proposal could allow councils to require cats to stay on their owners’ property, exclude them from public places, or impose curfews.
Which Cat Act is at issue, and what is its status?
This is about Western Australia’s Cat Act 2011, not South Australia’s dog-and-cat legislation. The Act sets requirements for cat identification, registration and sterilisation, and gives local governments functions to administer and enforce it. The official legislation register lists the Act as current, with an official version dated 25 September 2025: Western Australian Legislation.

On its review page, the WA Department of Local Government, Industry Regulation and Safety said: “The State Government is currently progressing the drafting of legislative amendments to enable local governments to make cat containment local laws.” That is a statement about drafting, not proof of an enacted law. The cited government material does not establish passage, assent or commencement by 4 October 2026. Check the current parliamentary record and your council’s rules before treating any proposed containment requirement as an obligation.
The proposal followed attempts by some councils to introduce containment measures. In a 25 February 2026 parliamentary statement, the issue was described as a legal uncertainty: the Joint Standing Committee on Delegated Legislation considered that the existing Cat Act did not authorise those measures. The proposed amendments are intended to clarify and create a route for council containment laws; they do not mean councils lack all powers under the current Act.

What containment rules could councils make?
The government’s announced examples are local options, not rules already in force statewide. A council could tailor its approach to local conditions and community support.
- Containment to the owner’s premises: cats would be kept on their owners’ property rather than allowed to roam.
- Public-place exclusion: cats could be prohibited from specified public areas.
- Curfew: cats could be kept indoors or otherwise contained during specified hours, while having different rules at other times.
These designs differ in scope. A curfew limits roaming at particular times; an exclusion rule concerns designated places; continuous premises containment is the broadest of the three examples. The government says councils may consider transition arrangements for people whose cats currently go outdoors, along with support to help owners adapt. No particular transition period has been established in the cited material.

Why give councils the choice rather than set one statewide rule?
The government has framed the proposal around local needs and community expectations. Council choice could let a local area select a measure suited to its circumstances, but it also means rules may differ across council boundaries. A statewide rule could be more consistent, while a local-law approach gives councils discretion over whether and how to act.

Implementation capacity matters too. WA’s Cat Local Law Guidelines note that councils’ needs and resources differ and explain that local laws are made through the Local Government Act process. Whether a council adopts restrictions, funds compliance work and supports residents are therefore practical questions, not just questions of legislative authority.
Wildlife protection is part of the government’s rationale. Its February 2026 announcement said roaming pet cats are estimated to kill millions of birds, reptiles and small mammals each year, but did not identify the estimate’s publisher or year. The figure should be understood as the government’s broad rationale, not as a fully attributed or precisely sourced wildlife statistic.

What did the 2026 review cover?
The statutory review builds on an earlier review conducted in 2019. The department invited feedback on registration, enforcement and compliance, sterilisation, microchipping, breeding, limits on the number of cats, and cat-management approaches used elsewhere in Australia. The consultation deadline was 5pm on Monday, 31 August 2026; it is not open now, and the cited sources do not report the number of submissions or the review’s outcome.

What should WA cat owners do now?
- Check current local rules. Contact your local government or read its current cat-related local laws. Do not assume the proposed options already apply in your area.
- Look for formal legislative updates. A drafting announcement is not enactment. Check whether a Cat Amendment (Local Laws) Bill has been introduced, passed and commenced before relying on a change.
- Consider practical containment options without assuming a mandate. If you want to prepare for the possibility of tighter local rules, an outdoor enclosure or catio can let a cat spend time outside while contained. No particular product or design is endorsed by the government.
- Follow your council’s consultation and implementation announcements. If new powers take effect, the council will be the relevant source for any proposed local rule, commencement date, transition arrangement and compliance details.
