Contact the shelter or rescue immediately, explain what happened, and ask whether the cat is still in its care and whether an adoption or transfer was completed. Save your records and avoid confronting the other person or trying to take the cat yourself. Whether you had a legal right to the cat depends on the agreement, whether custody was transferred, and the law where you live.
What to do first
- Call or visit the shelter or rescue. Give staff a clear timeline: when you applied, what the agency told you, whether you signed anything or paid, and when the other person took the cat. Ask whether the cat is still in the agency’s care, whether an adoption or transfer was finalized, what records the agency has, and who handles competing claims. Miami-Dade County advises people claiming a pet that has already been adopted out or is no longer available to visit Animal Services promptly and discuss the situation with staff; that is local guidance, not a nationwide rule. - Ask the agency to preserve and review its records. Request written confirmation of the cat’s status and ask how the agency handles disputed claims. Keep your description factual; do not call yourself the legal owner unless the agreement, custody history, and applicable law support that claim.
- Preserve what you already have. Save the application, emails, texts, appointment confirmations, adoption or foster agreement, payment receipts, and any messages about who would take the cat and when. Keep original messages and documents where possible.
- Do not confront the other person or retrieve the cat yourself. If there is an immediate threat or the cat is in immediate danger, prioritize safety and contact the appropriate local emergency or law-enforcement service. - If the dispute continues, get advice for your location. Ask the agency what its process is and consider contacting a local attorney or appropriate legal-aid service. Rules about ownership, evidence, agency authority, and remedies vary by jurisdiction.
Why the adoption stage and custody matter
An application, approval, reservation, or payment may not have the same effect as a completed adoption. The signed agreement and what actually happened at handoff matter. For example, the City of Albuquerque adoption contract says, “Transfer of ownership takes place at the time you TAKE CUSTODY of the animal.” That wording applies to that contract; it is not a universal rule. Read your own agreement and ask the agency to explain how its records describe the transfer. City of Albuquerque adoption contract.
How to organize evidence
Make a dated timeline while events are fresh. Note who said what, when, and how; retain the original records rather than relying only on memory or screenshots without context.
- Adoption-stage records: application, approval, reservation, adoption, foster, or surrender paperwork, especially terms about custody, transfer, cancellation, or return.
- Communications: messages with agency staff or the other person about the cat, the intended adopter, and the planned handoff.
- Payment records: receipts or payment confirmations, if any. A payment can be relevant context, but do not assume it alone settles who is entitled to the cat.
- If you took custody: handoff records, veterinary records, licensing or registration, rabies certificates, and microchip documentation. - Witness details: names, dates, and contact information for anyone who saw or heard an agreement or transfer.
What not to assume
- An application or fee does not automatically settle the issue. The agreement and custody facts matter; one Albuquerque contract, for example, defines the transfer point as taking custody. City of Albuquerque adoption contract.
- A microchip entry or one receipt may not decide a contested claim. Authorities may consider several records, and some jurisdictions refer disputed ownership for an agency determination. New Jersey law and animal-claim records; Victoria guidance on disputed animal ownership.
- Animal control may not be able to retrieve the cat immediately. Los Angeles County says officers must follow legal process before seizure. Los Angeles County guidance on animal-control process.
- Another place’s deadline or procedure may not apply to you. The cited materials concern different jurisdictions and circumstances; confirm the process with the agency and authorities where the cat is located. Miami-Dade County Animal Services guidance; New Jersey law; Victoria guidance.
Which details shape the next step?
The agency’s answer will depend in part on the cat’s current location and the point the adoption reached. An application or reservation is different from a signed adoption; a signed agreement is different from an actual handoff; and the agreement may specify when transfer or return occurs. Ask whether the shelter, animal control, or another person currently has the cat, then focus your questions and records on that specific status.
