In the United States, the attacking dog’s owner or keeper may be legally responsible for veterinary damages, but responsibility depends on the law where the attack happened and the facts of the incident. Their homeowners or renters liability insurance may cover a claim, subject to the policy. Separately, the injured dog’s own pet insurance may reimburse eligible treatment. These are different routes: none guarantees that the clinic will be paid directly or that a claim will be approved.
Who may owe the veterinary bill?
The attacking dog’s owner, keeper, or another person legally responsible for the dog may owe damages if the applicable state law makes them liable and the evidence supports the claim. “May” matters: state rules differ, and an owner’s responsibility is not established simply because their dog was involved in an incident. Relevant questions can include what the law says, how the attack occurred, whether an exception applies, whether the dog caused the injuries, and what veterinary costs are documented.

In practice, the injured dog’s owner may have to pay the clinic before anyone decides who is legally responsible. The owner can then pursue the other party or an insurer, use their own pet policy if it covers the treatment, or face a dispute about liability, coverage, or the amount claimed. Paying for care upfront does not concede who was at fault.

Why the law where the attack happened matters
There is no single nationwide dog-attack rule that answers every dog-on-dog claim. States use different statutes and legal approaches, and a statute written for a dog bite to a person may not apply to an attack on another animal. The incident’s location is the starting point for determining which law applies; do not assume a rule from another state—or a general summary of “one-bite” laws—decides your case.

Ohio: the statute expressly includes injury to property
Ohio Revised Code § 955.28(B) says that a dog’s owner, keeper, or harborer is liable in damages for injury, death, or loss to a person or property caused by the dog, subject to statutory exceptions. The wording’s reference to property is relevant to an injured-dog claim, but it does not resolve every issue in a particular case. The facts, statutory exceptions, proof of causation, and the damages claimed still matter. Consult the official Ohio Revised Code and a lawyer licensed in Ohio for advice on a specific incident.
Florida: distinguish a bite to a person from damage to an animal
Florida Statutes § 767.04 addresses a dog that bites a person. It is not, by itself, a general rule for a dog injuring another dog. Florida also has § 767.01, which addresses damages to persons, domestic animals, or livestock. The distinction illustrates why readers should check a statute’s actual scope rather than apply a human-bite provision to a veterinary claim. The official Florida Legislature publishes Chapter 767. Whether a particular provision applies depends on the facts and legal analysis.

Across the country, legal frameworks can include statutes, negligence rules, and common-law approaches sometimes described as “one-bite” rules. The Insurance Information Institute (Triple-I) provides a general overview of these frameworks, not a state-by-state legal determination. Do not treat any general overview as a substitute for the law governing the place of the incident.
Three separate routes can affect who pays
A claim can involve legal responsibility, an insurance decision, and the practical question of who pays the veterinarian first. Those questions can have different answers and timelines.

| Payment route | What it may do | What to verify |
|---|---|---|
| Claim against the attacking dog’s owner or keeper | May seek veterinary damages if the person is legally responsible under the law that applies. | Applicable law, exceptions, evidence linking the attack to the injury, and supported damages. |
| Attacking dog owner’s homeowners or renters liability insurance | May respond to a claim if the incident and claimed damages are covered by the policy. | Coverage decision, relevant policy language, exclusions, and applicable limit. |
| Injured dog’s own pet health insurance | May reimburse eligible accident treatment under the injured dog’s policy. | Accident coverage, exclusions, waiting periods, deductible, reimbursement percentage, limits, and payment process. |
These tracks are not interchangeable. A pet insurer’s decision to reimburse treatment does not establish that the other owner was legally liable. Similarly, a liability claim being made does not mean the other owner’s insurer must cover it. Tell insurers about other payments or claims involving the same expenses and do not seek or retain more than the amount recoverable for the same loss.
When the other owner’s homeowners or renters insurance may help
Homeowners and renters policies commonly include personal liability protection, but the policy—not a general description of insurance—determines whether a particular dog-on-dog incident is covered. The National Association of Insurance Commissioners (NAIC) describes personal liability as protection for financial losses from property damage and personal injury to others when the insured is found legally responsible. Triple-I explains that homeowners and renters policies typically cover dog-bite liability while also noting that exclusions and policy limits can apply. Those general explanations do not establish coverage for veterinary damages in an individual case.

The attacking dog’s owner should notify their insurer promptly and ask whether the personal liability section will consider the claim. The injured dog’s owner can ask for the insurer’s claim contact and provide records through the process the insurer specifies. The insurer may investigate both liability and the amount of damages; it may accept, dispute, or deny the claim under the policy and applicable law.
Ask for the actual policy terms and a written position
Coverage can turn on the policy’s definitions and exclusions as well as the circumstances of the incident. The dog’s breed, prior behavior, where the attack occurred, and other policy-specific facts may matter. Ask the insurer to identify the relevant policy provisions and provide its coverage decision in writing. Do not rely only on a verbal assurance that “dog incidents are covered.”

A liability limit caps what the insurer may pay under the applicable coverage. If damages exceed that limit, the owner may remain personally responsible for the excess if they are legally liable. Triple-I’s consumer guidance describes that exposure, including legal expenses, but the amount available and what the policy covers must be determined from the actual policy. A limit is not a promise that the insurer will pay that full amount for every claim.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone. When your dog’s own pet insurance may help
Check the injured dog’s policy for accident coverage and the specific conditions that apply to this injury. Read the policy or ask the insurer about any waiting period, deductible, reimbursement percentage, exclusions, benefit limits, documentation requirements, and claim deadline. A policy may cover eligible treatment without deciding who caused the injury or whether the other owner owes damages.
Cash flow can be different from final reimbursement. NAIC says some pet insurers pay veterinarians directly, but owners often pay the full treatment cost at the time of care and later receive reimbursement for covered expenses. Ask your insurer whether direct payment is available for your policy and clinic, and what approval or paperwork is required. Do not assume direct payment is an option or that the insurer will reimburse the entire invoice.

- Arrange veterinary care. Prioritize your dog’s health and follow the veterinarian’s advice. Request itemized invoices and a copy of the treatment record so that charges and the documented injuries are clear.
- Record what happened. Write down the date, location, and sequence of events while details are fresh. If it is safe, photograph visible injuries and the scene. Collect witnesses’ names and contact information.
- Exchange information. Record the other dog’s owner or keeper’s contact details and insurer information if available. Keep communications factual and save copies of messages, bills, and records.
- Notify relevant insurers promptly. Contact your pet insurer to ask about accident coverage and claim steps. The other owner should notify their homeowners or renters insurer; the injured dog’s owner can ask for the liability insurer’s claim contact and submit requested documentation. Follow each insurer’s instructions and keep a record of when you reported the incident.
- Ask specific coverage questions. For the other owner’s insurer, ask whether it is investigating the claim under liability coverage, which policy provisions may apply, what limit is relevant, and whether it will provide a written coverage position. For your pet insurer, ask what treatment is eligible, what you must pay first, and how reimbursement or direct payment works.
- Keep the claim organized. Save itemized invoices, treatment records, photos, witness details, insurer correspondence, and proof of payments together. Send copies when requested and retain the originals.
- Get legal advice if the dispute is material. If the other owner denies responsibility, an insurer disputes coverage, or the amount of damages is contested, consult a lawyer licensed in the state where the incident occurred.
What can and cannot be inferred from national dog-bite claim figures
In its April 10, 2026 report, Triple-I reported 28,450 U.S. homeowners-insurance dog-bite claims in 2025, compared with 22,658 in 2024. It reported an average cost of $65,450 per dog-bite claim in 2025, compared with $69,272 in 2024. These figures describe homeowners-insurance dog-bite claims; they are not estimates of veterinary expenses after one dog injures another. They cannot predict the bill, liability outcome, or insurance payment in an individual dog-on-dog case.
Common mistakes that can complicate a claim
- Assuming the other owner’s insurance automatically covers it. Coverage depends on the policy and the insurer’s review, even where liability may exist.
- Using a human dog-bite rule for an animal injury. Check whether the statute actually covers damage to domestic animals or property.
- Confusing treatment coverage with fault. Your pet policy may reimburse eligible costs even while a liability dispute continues.
- Relying on an unitemized total. Preserve invoices and records that show the treatment provided and the charges claimed.
- Assuming the insurer pays the clinic immediately. Owners often pay at treatment and seek reimbursement later; confirm the process with the specific insurer.
- Assuming a policy limit guarantees payment. A limit is a maximum subject to coverage and liability, not an automatic payout.
- Failing to disclose another payment. Tell insurers about payments or reimbursements from another route, and do not seek double recovery for the same expense.
Which source can answer which question?
For legal responsibility, start with the statute and legal rules in the incident’s state; the Ohio Revised Code and Florida Legislature’s Chapter 767 illustrate why scope differs. For general homeowners liability concepts, NAIC’s consumer homeowners guidance and Triple-I’s dog-owner liability guidance explain common coverage structures and limitations. For pet insurance reimbursement practices, consult NAIC’s consumer pet-insurance guidance and the terms issued for your dog’s policy. General consumer guidance can frame the questions to ask, but only the governing law, incident facts, and actual policy can resolve a particular claim.
