Can a Breeder Take Your Dog Back Over Disputed Vaccine Records?

A vaccine-records disagreement does not automatically return ownership to a breeder. The transfer agreement, any conditional clause, state law, evidence, and your veterinarian’s guidance all matter.

Usually, no—not automatically. After a completed gift or sale, a breeder generally does not gain an instant right to repossess a dog merely because vaccination records are missing, disputed, or were not delivered as promised. The answer can change if the transfer agreement reserved ownership, made the placement conditional, created co-ownership, or included an enforceable return clause. The law of the state where the dispute occurs also matters.

If a breeder says she will retrieve the dog, preserve the transfer and veterinary evidence, do not surrender the animal based only on a threat, and obtain advice from a lawyer licensed in your state. Ask your veterinarian how to handle an unknown vaccine history while the ownership question is sorted out.

What determines whether the breeder still has rights?

The first question is not who has the better argument about vaccines. It is what legally happened when the dog changed hands. A completed transfer can be a gift, a sale, a placement with conditions, or a co-ownership arrangement. Those categories can produce very different results.

Gift

A genuine gift normally involves delivery of the dog and an intent to give ownership without payment. Texts, emails, a signed gift statement, registration information, and the date the dog came into your care can help show that the transfer was complete. A breeder’s later dissatisfaction does not by itself rewrite a completed gift. A written condition—such as a right to reclaim the dog if a stated obligation is not met—must still be interpreted under applicable law.

Sale

A sale is supported by a bill of sale, payment records, receipts, and messages describing the transaction. Review whether the contract identifies any warranty, health-document obligation, return period, or specific event that would allow the seller to demand return. A disagreement over paperwork is not automatically the same as a breach that ends the sale.

Conditional placement or co-ownership

Some breeder arrangements retain breeding, showing, registration, or other rights. The document may call the parties co-owners or state that ownership reverts if certain obligations are not met. In that situation, the exact language, the parties’ conduct, and the materiality of the alleged breach become central. Do not assume that a clause labeled “reclaim,” “reversion,” or “return” is self-executing.

Transfer evidence What it can help establish What it does not establish by itself
Signed gift, adoption, or sale document Whether ownership was intended to pass and what conditions were written That every condition is enforceable or that a breach occurred
Payment, receipt, or dated messages That a sale or completed handover occurred That the breeder has no contractual remedy
Microchip registration A record connecting you with the dog and a date of registration Conclusive legal title in every jurisdiction
Veterinary records after transfer Continuity of your care and the dog’s current medical history Proof that earlier vaccines were or were not given

A breeder’s threat is not a legal ruling

A message saying “I am coming to get the dog” states an intention, not a court determination. If the breeder claims a continuing ownership interest and you disagree, the dispute may require a civil proceeding or other formal legal process. The informational response underlying this topic notes that police typically do not intervene in animal-custody disputes. That does not predict what an officer will do in a particular incident, but it is a reason to organize your documents and seek local legal advice rather than relying on an argument at the door.

Do not physically fight over the dog or hide evidence. Keep communications calm and in writing. If the breeder appears in person, you can state that you do not consent to surrendering the dog and that ownership is disputed; contact a lawyer or local authorities if there is a threat of violence, unlawful entry, or an immediate safety emergency. Those safety issues are separate from deciding who owns the animal.

Read the contract as a whole

Locate every document and message exchanged before and after the transfer. Look for definitions of owner, co-owner, breeder, purchaser, guardian, or lessee; promises to provide records; deadlines; cure periods; return procedures; and clauses describing what happens after an alleged breach. A promise to provide vaccine records may support a claim for records or another contractual remedy without automatically transferring ownership back.

What the 2025 New York case illustrates

In Kuzma v Honeycutt, a New York trial-level court interpreted a co-ownership and purchase contract involving updates, health testing, showing, and breeding. The contract said ownership would immediately revert after any breach. Reading the document and its context together, the court found that language excessively broad and ambiguous and limited it to material or specifically identified breaches. The court did not order the dog returned for the alleged failures to provide updates and complete health testing.

The court wrote: “This excessively broad and ambiguous provision should therefore be limited in its construction to avoid an absurd result.” That sentence reflects the court’s interpretation of that contract and those facts. Kuzma was not a vaccine-records case, is not a nationwide rule, and does not make every breeder return clause unenforceable. Its practical lesson is narrower: a court may examine whether the alleged violation is material, whether the contract clearly identifies it, and whether automatic forfeiture would fit the parties’ bargain.

  • Payment records or other proof of a gift and the date the dog was delivered.
  • Microchip registration details, transfer confirmations, and licensing records.
  • Veterinary invoices, examination notes, vaccine entries, prescriptions, and boarding or insurance records created while the dog has been with you.
  • A timeline listing the handover date, requests for records, responses, and any threats or attempted pickup.

A pet medical-records organizer can keep these papers together, but it does not prove ownership or replace legal advice. Store a backup somewhere the breeder cannot access.

How to request the vaccine records

Make one clear written request and preserve the sent message. Identify the dog by name, microchip number if available, and date of transfer. Ask for copies of all vaccination and other veterinary records that were promised or are in the breeder’s possession, and give a reasonable date for response. Keep the request factual: you are seeking the records, not admitting that the breeder retains ownership.

If the breeder says the records are held by a clinic

Ask for the clinic’s name and permission, if needed, to obtain a copy directly. Your veterinarian can also explain what information is medically useful and whether the prior clinic can transmit records. Do not assume a missing document means a vaccine was never administered; absence of paperwork proves only that the paperwork is unavailable to you.

If the breeder refuses or ignores the request

Save the refusal or lack of response in your timeline. The contract, a state consumer or animal-sale statute, or a court process may provide a route to obtain documents, but the available remedy depends on the jurisdiction and the type of transaction. A state-licensed attorney can match the request to the correct procedure. Avoid threats, public accusations, or attempts to access the breeder’s accounts.

What to do about an unknown vaccine history

Tell your veterinarian exactly what is known and what is missing, including the dog’s age, prior medical records, and any dates you can verify. The veterinarian—not the breeder’s dispute—should determine how to evaluate the dog and what care is appropriate. Animals with unknown histories are routinely assessed and vaccinated when a veterinarian considers that appropriate, but an individual plan depends on the dog’s health and circumstances. Do not infer medical status from the parties’ argument.

Ask the clinic to record the source and reliability of each historical entry and to give you copies of new records. Keep those records with the transfer documents. They show continuity of care, although they do not alone decide title.

State statutes can help with records, but they do not automatically decide ownership

Pet-sale laws are limited by their definitions, covered transactions, and deadlines. A rule requiring disclosures is different from a rule authorizing repossession. Check the current text and coverage in your state before relying on any statute.

State example What the cited law addresses Important limits
Delaware For covered sellers, known vaccination and worming information (including dates and type of treatment) and known veterinary diagnosis, treatment, or medication information must be provided at sale. Covered sellers must retain the written record for at least two years. The chapter includes defined purchaser remedies, deadlines, and seller-examination procedures for specified illness or condition claims. Exceptions include a threshold exemption for certain small-volume sellers. These are disclosure and pet-warranty provisions, not a general rule permitting or forbidding a breeder to reclaim a dog in a records dispute.
Florida, section 828.29 For specified dogs and cats offered for sale, an official certificate of veterinary inspection must include detailed vaccine information; the seller gives the buyer a copy and keeps one. Covered pet dealers must also provide copies of pre-sale examination or test records and medication records, with statutory deadlines and remedies for specified claims. Coverage depends on the statutory seller and transaction definitions. A private gift or a breeder transfer outside those definitions is not automatically covered.

The American Kennel Club’s December 2020 policy analysis describes features common in state “puppy lemon law” systems, including choices such as return and refund, exchange, or keeping the animal with reimbursement; timely notice and supporting documentation; and a possible second veterinary opinion. It is an older, secondary overview, not a substitute for the current statute in your state.

When legal advice is especially important

Consult a lawyer licensed where the dog is located if the breeder claims the dog was only loaned, says she remains a co-owner, points to a forfeiture or reversion clause, demands immediate surrender, threatens self-help, or files a court claim. Bring the complete evidence file, not just the vaccine correspondence. Ask the lawyer to identify the transfer type, explain the likely forum and remedies, and advise what communication is safest while the matter is pending.

If you received the dog as a gift or bought it outright and the only dispute is that promised records were not supplied, tell the lawyer that chronology. If the agreement made placement conditional, provide the exact condition and any evidence that you complied or were given an opportunity to cure. Small wording differences can change the analysis.

A practical checklist for the next 48 hours

  1. Save the contract, messages, receipts, microchip information, and veterinary records in two locations.
  2. Write a dated timeline from the transfer through the latest demand.
  3. Send one concise written request for the vaccine and other promised records.
  4. Book or maintain a veterinary appointment and disclose that the history is incomplete.
  5. Do not voluntarily surrender the dog solely because the breeder threatens to retrieve it; obtain local legal advice first unless an immediate safety issue requires a different response.
  6. If the breeder attempts to take the dog or starts a legal action, contact a state-licensed attorney promptly and provide the organized file.

What the evidence can—and cannot—answer

Documents can show what the parties agreed, when possession changed, what records were promised, and how the dog has been cared for. They cannot by themselves guarantee how a court will interpret an ambiguous clause, whether a state statute covers the transaction, or what medical treatment is appropriate now. Those questions require the law of the relevant jurisdiction and advice from the appropriate professional.
