In the United States, a person generally should not assume they can keep or give away a service dog they found. The ADA defines service animals for certain public-access situations, but it does not decide ownership of a lost dog or create a general right to transfer one. State and local found-animal laws determine what a finder must do, including reporting, custody, notice, and any later disposition. Contact local animal control or law enforcement promptly and follow its instructions before retaining or transferring the dog.
Does the ADA let someone keep or rehome a found service dog?
No. The ADA’s definition of a service animal is an access rule, not an ownership rule. For Titles II and III, the Department of Justice defines a service animal as a dog individually trained to do work or perform tasks for a person with a disability (28 CFR § 35.104).
DOJ guidance says the handler is responsible for the animal’s care and supervision in covered settings. That allocation does not give a finder permission to claim ownership if the dog is separated from its handler (DOJ service-animal requirements).
Nor does a business or public entity’s ability to require a dog’s removal in limited circumstances create a right to keep it. Under the ADA, removal may be required when, for example, the animal is out of control and the handler does not take effective action, or it is not housebroken; those access rules do not authorize a bystander to rehome the dog (28 CFR § 35.136).

What should you do if you find a service dog?
- Protect the dog and note the circumstances. Record where and when you found the dog and any immediate safety or veterinary concern. Do not treat temporary help as a transfer of ownership.
- Look for identification and contact local animal control or law enforcement. Follow the authority’s instructions for checking a tag or microchip through appropriate channels and for reporting or delivering the dog.
- Keep a record of reasonable efforts to identify the handler. Ask the relevant authority what notice, custody, and holding-period rules apply where the dog was found.
- Do not give the dog away or decide to keep it before the local process is complete. If the owner is known or someone disputes custody, get advice from a local lawyer familiar with animal law.
These are prudent steps, not a single nationwide statutory checklist. The precise duty, deadline, and official responsible for custody depend on state and municipal law and the facts of the case.
Why the rules vary by location
State and local laws may specify how a finder reports a lost or stray dog, where the dog must be delivered, how long it is held, and who may authorize its eventual disposition. The following are examples, not rules for the entire country:

- Massachusetts: State law addresses holding or harboring another person’s domesticated animal without authorization. It also addresses a lost or strayed animal held for more than 48 hours without being reported or taken to the nearest police station or dog officer with identifying information. That 48-hour language is a Massachusetts rule, not a national deadline (Massachusetts General Laws, chapter 272, section 85A).
- Maine: The statute directs an animal-control officer, or a person acting in that capacity, to take a dog found at large to its known owner or deliver it to a shelter under the statutory procedure (Maine Revised Statutes, title 7, section 3913).
- Texas: State law provides for local ordinances or rules to set stray-dog impoundment periods, so the applicable procedure may depend on the locality (Texas Health and Safety Code, chapter 822).
These differences are why a finder should ask the local authority which rule applies rather than infer a holding period from another state’s law.
Does a vest or certificate prove the dog’s status or ownership?
No. DOJ explains that ADA service dogs do not need a special vest or identification, and covered entities generally cannot require certification or training records as a condition of public access (DOJ service-animal requirements). A vest, certificate, or lack of either therefore does not settle who owns a found dog. Use identification and the local reporting process to help locate the handler; do not use appearance or paperwork alone to decide that the dog is abandoned or available to rehome.

What if the owner is known, or the dog needs urgent help?
If the handler can be identified, contact them through reliable details on the dog’s identification or with help from animal control or law enforcement, and follow local instructions for returning the dog. If a custody dispute has already arisen, seek local legal advice rather than trying to resolve ownership by transferring the animal.
If the dog is in immediate danger or needs urgent veterinary attention, contact animal control, law enforcement, or an emergency veterinarian for direction.
