In the United States, the ADA generally protects a service dog handler’s access to covered public places and state or local government services, but it does not guarantee that a dog can remain with its handler in every circumstance or require a business or agency to care for the dog. A dog may be excluded for the specific behavioral reasons in the ADA regulations; narrow safety or access restrictions can also depend on the setting and facts. If separation is necessary, responsibility for arranging the dog’s care generally remains with the handler. Air travel follows a different federal law, the Air Carrier Access Act (ACAA).
When does the ADA protect a service dog’s access?
Title III of the ADA covers public accommodations, such as businesses open to the public. Title II covers services, programs, and activities of state and local governments. Both generally require covered entities to modify policies to allow a service animal to accompany its handler in areas open to the public or program participants. The access rules appear in the U.S. Department of Justice regulations at 28 C.F.R. § 35.136 and 28 C.F.R. § 36.302.
For ADA purposes, a service animal is generally a dog trained to do work or perform tasks for a person with a disability. The rules discussed here do not treat emotional-support animals as service animals. A dog is generally expected to be harnessed, leashed, or tethered. If the handler’s disability prevents using one of those devices, or it would interfere with the dog’s safe, effective work, the handler must use another effective means of control, such as voice commands or signals.
When may a business or government entity ask for the dog to be removed?
The ADA regulations identify two behavioral grounds for requiring a service animal’s removal: the dog is out of control and the handler does not take effective action to control it, or the dog is not housebroken. A concern or assumption alone is not one of those stated grounds. Where a dog is properly excluded, the entity must still offer the person the opportunity to obtain its goods or services or participate in its program without the dog.

- Out of control: The handler must fail to take effective action to bring the dog under control. The rule concerns the dog’s behavior and the handler’s response.
- Not housebroken: The dog is not housebroken.
Does a covered entity have to care for the dog during separation?
No general ADA duty requires a public accommodation or public entity to take custody of, supervise, or provide care for a service animal. The regulations say this expressly: “A public entity is not responsible for the care or supervision of a service animal.” The parallel Title III provision applies the same principle to public accommodations. See 28 C.F.R. § 35.136(e) and 28 C.F.R. § 36.302(c)(5).
DOJ’s regulatory history explains that if separation is required to avoid a fundamental alteration or a safety threat, the individual is responsible for arranging care and supervision for the dog during that period. That explanation is not a blanket authorization to separate a handler and dog whenever an entity invokes safety: the reason, location, available access, and facts matter.

What if the handler is hospitalized or cannot care for the dog?
The DOJ says it is preferable for a service animal and handler not to be separated. If a hospitalized patient cannot care for the dog, DOJ suggests that the patient arrange for a family member or friend to provide care, or ask whether the hospital can keep the dog during the hospitalization. This is practical guidance, not a requirement that every hospital provide animal care. The underlying regulation still says covered entities are not responsible for a service animal’s care or supervision.
Can a hospital restrict a service dog from some areas?
DOJ guidance recognizes that access may be limited in areas where the dog’s presence would compromise safety or sterile conditions. It gives operating rooms and burn units as examples, while generally allowing service animals in other areas where patients or visitors may go. A restriction tied to a particular area and its conditions is different from a broad policy excluding service dogs throughout a facility.

Emergency situations do not have one universal separation rule established by the sources cited here. For a particular incident, relevant questions include which entity is responsible, why separation was required, whether the dog was under control, what alternative access or service was offered, and who could arrange care for the dog.
What applies when separation happens during air travel?
Air travel is governed by the ACAA, not the ADA. The U.S. Department of Transportation (DOT) advises passengers who believe their ACAA rights have been violated to ask the airline for a Complaints Resolution Official (CRO). DOT’s guidance does not establish an absolute right to keep a dog with its handler in every disruption or emergency, or a blanket airline duty to care for the animal during separation.

What should you do if a service dog is separated from its handler?
- Identify the setting and reason. Determine whether the incident involves a public accommodation, a state or local government service, a hospital, or an airline. Ask for the specific reason for separation, such as the dog’s behavior or a restriction in a limited-access area.
- Ask what access remains available. If the dog is properly excluded under an ADA behavioral rule, the person must still be offered the goods, services, or participation without the dog. If the issue is a limited-access area, clarify whether the handler can continue to access other areas with the dog.
- Arrange care if separation is necessary. The ADA does not generally make the entity responsible for the dog’s care. In a hospitalization, DOJ suggests contacting a family member or friend, or asking whether the hospital can keep the dog.
- Use the relevant complaint route. For an air-travel concern, ask the airline for a CRO. For other incidents, the applicable ADA rules and any state or local protections may depend on the facts and jurisdiction.
