Can Tortoises and Other Exotic Animals Be Kept in UK Parks?

There is no blanket UK permission to keep tortoises or other exotic animals in parks. Species, public exhibition, welfare and containment rules, and park-owner approval all matter.

Sometimes, but there is no blanket permission for keeping animals in UK parks. The answer depends on the exact species, whether the animals are being exhibited to the public, the rules on keeping and containing them, and permission from whoever controls the particular park. A tortoise is not automatically exempt just because it is familiar or kept in an enclosure.

Start with the exact species and activity

“Exotic animal” is not one legal category with one set of rules. Requirements can depend on the species and what you plan to do with it. Some wild, dangerous, exotic or protected animals may require a licence; check the specific animal and circumstances with the relevant authority rather than assuming that a tortoise or another commonly kept species is unrestricted. GOV.UK explains the application process for animals covered by its wild-animal licensing guidance: Apply for a licence to keep a wild animal.

Keeping an animal privately and displaying it to park visitors are also different situations. Before making a proposal, identify the species, the location, who will keep it, and whether members of the public will be able to view it.

Could a park with animals need a zoo licence?

A site that exhibits wild animals to the public may fall within the zoo-licensing framework. GOV.UK says operators of qualifying zoos open to the public for at least seven days in a 12-month period must have a zoo licence, subject to applicable exemptions or dispensations. Whether a particular park setup qualifies is assessed by the local authority; the presence of an animal alone does not settle the question.

Licensing does not replace welfare duties

Keepers must meet the requirements that apply to the animal and check whether a licence is required. Government guidance also notes that keepers may need to demonstrate lawful ownership where relevant. A licence, where required, should not be treated as proof that a proposed enclosure or keeping arrangement is suitable for the animal’s welfare.

Containment and release are separate legal questions

An enclosure does not by itself answer every rule about non-native animals. Government guidance says live non-native animals must not be allowed to escape into the wild. Defra’s section 14 guidance describes restrictions on releasing animals not ordinarily resident in, or regular visitors to, Great Britain in a wild state, as well as restrictions concerning listed species.

Those rules distinguish controlled keeping from release, but an enclosure is not a guarantee that every relevant requirement has been met. Check the species and proposed arrangement against Defra’s section 14 guidance. Get permission for the particular park

National animal-keeping guidance does not grant permission to install an enclosure or operate an animal exhibit on public parkland. First establish who owns or manages the site, then ask that body what permission, lease, local rules or other approvals apply to the specific proposal. Without a named park, its landowner, local requirements and permission cannot be determined.

  1. Define the proposal: name the species, explain who will keep it, describe the enclosure and state whether it will be shown to visitors.
  2. Check animal-specific rules: ask the relevant local authority or agency whether the species or activity requires a licence or has other restrictions.
  3. Ask the park controller: identify the landowner or manager and request written guidance on permission to use the site.
  4. Confirm the regulatory route: if the animals will be exhibited, ask the local authority whether zoo-licensing requirements, exemptions or dispensations apply.
  5. Plan for welfare and containment: show how the arrangement meets the animal’s applicable requirements and prevents escape; check whether any release restrictions apply.
