Can You Keep a Cat You Find? Microchips, Ownership and Local Rules

A cat outdoors or without a tag is not necessarily abandoned. Find out how to report a found cat, check for a microchip and follow local rules before adopting it.

Sometimes—but not simply because a cat is outside, has no visible tag or has not been claimed yet. A found cat may have a home, and the rules for reporting, searching for an owner and holding the animal depend on where you found it. Keep yourself safe, contact a local animal service about identification and a microchip scan, and follow the required local process before considering adoption.

Why you should not assume a found cat is abandoned

Cats spend time outdoors for different reasons. A cat that appears to be wandering may belong to someone nearby, and the absence of a collar or visible identification does not establish that it is ownerless. Ottawa Humane Society guidance recommends taking steps to find an owner; the City of Irvine likewise tells people reporting found cats not to assume they are abandoned.

“Can I keep it?” therefore has two separate answers. You may need to provide temporary help while the cat is in your care, but that does not necessarily give you the right to treat it as yours. Whether a finder can eventually adopt an unowned or unclaimed cat depends on the local reporting, owner-search and holding procedure. The guidance described here does not establish one waiting period that applies everywhere.

What to do first if you find a cat

1. Put safety ahead of catching the cat

Do not chase a frightened or skittish cat, reach for one that appears aggressive, or try to handle an animal if you are unsure how it may react. An unknown, distressed or injured cat may bite or scratch. The ACT Government’s guidance, published 1 October 2026, says: “Never approach an animal if you feel unsafe or are unsure how it may react.” If the cat is in traffic, injured or creating a safety concern, contact the animal service responsible for the place where you found it and ask what to do. Irvine’s municipal guidance, for example, asks finders to contact the city when a found animal is sick, injured or presents a safety concern.

2. Check for visible identification only if it is safe

If you can do so without putting yourself or the cat at risk, look for a collar or tag and use its contact details to try to reach the listed person. A tag is a useful lead, not a reason to skip local reporting rules. If there is no tag—or you cannot safely check—the next step is to ask a local veterinary clinic, animal-control service, council or shelter about scanning and the local found-pet procedure.

3. Call before transporting the cat

Ask whether the service accepts found cats, whether it can scan for a microchip, and what it wants you to do next. Services differ: a clinic may scan voluntarily, may not accept a found animal, or may refer you to animal control or a shelter. Irvine advises people to call first, and Victoria’s provider guidance describes veterinary reunification service as voluntary. Do not leave a cat outside a closed clinic or shelter; Victoria’s government guidance warns against abandoning animals at closed facilities.

If the cat is already safely contained and the service confirms it can help, transport it in a secure carrier or another suitable container. Ottawa Humane Society mentions a cat carrier or cardboard box for taking a cat to a local vet for scanning. That is a transport suggestion, not a reason to chase or force an unfamiliar cat into a container.

4. Report the find and make a local owner search

Follow the reporting instructions from the authority or shelter responsible for the location where you found the cat. Depending on local guidance, owner-search steps may include checking lost-pet listings, asking nearby residents, posting a found-pet notice, and submitting a found-pet report. Ottawa Humane Society specifically advises finders to submit a found-pet report. Keep track of when and where you found the cat and which service you contacted so you can give consistent details when reporting it.

A person who responds to a social-media post is not automatically the owner. Victoria warns that mistaken claims can arise through social media and directs participating providers to use its reunification process. If someone claims the cat, ask the local authority or shelter how to verify the claim rather than handing the cat over solely on the basis of an online message.

5. If you are temporarily caring for the cat, keep it secure

If a local service says you may hold the cat while owner-search efforts continue, keep it in a quiet, secure place away from traffic and other pets, and provide water. Get instructions from the service handling the case about what to do next. Temporary shelter is not a substitute for required reporting, scanning or an official hold.

What a microchip scan can—and cannot—tell you

A scanner can read a microchip identifier; the associated registry may then provide a way to contact the person listed for the animal. A scan is useful because it can reveal a lead that is not visible from outside the cat. It does not, by itself, prove that the registry information is current or settle every dispute about legal ownership.

Records can become outdated when people move or transfer a pet without updating the registry. Victoria’s guidance for participating vets and shelters says providers should check relevant records, including microchip and council registration information. If those records conflict and doubt about legal ownership remains, the provider must relinquish the animal to council to determine ownership. That is a Victoria-specific operational procedure for participating providers, not a universal rule for finders or clinics elsewhere.

A missing chip is not proof of abandonment either. It only means that this identification route did not establish a listed owner. Continue with the local reporting and owner-search steps, and ask the responsible authority what must happen before the cat can be treated as unowned or considered for adoption.

Local examples: the rules depend on where you found the cat

The following examples illustrate why there is no safe universal answer or deadline. They apply to the places named, not to every jurisdiction in the same country. Confirm the current procedure with the responsible local authority before deciding to keep a cat.

Victoria, Australia

Agriculture Victoria’s found-animal guidance, last updated 2 September 2026, says a finder must take a lost or stray cat or dog as soon as reasonably possible to the local council, a vet that accepts lost pets, a registered shelter or an approved provider. Council holds unidentified animals for an owner-reclaim period and can advise the finder about adoption if the animal is unowned or is not reclaimed. The guidance does not provide a universal waiting period in the information summarized here.

Victoria also cautions that directly reuniting an animal with an owner instead of following the legislative requirements may result in a fine. Its separate guidance for participating vets and shelters, last updated 28 July 2026, describes provider scanning and ownership-verification steps; its 24-hour owner-identification timeline is part of that provider process, not a general deadline for every finder. When microchip and council records disagree and legal ownership is doubtful, the provider refers the case to council.

Miami-Dade County, Florida

Miami-Dade County’s official FAQ says that for a dog or cat without a license tag or other identification, the finder should notify Animal Services and obtain a microchip scan within 72 hours. If the scan identifies a registered owner, the finder should contact that owner within 24 hours. The FAQ says a finder may hold the pet at home while trying to find the owner. These are Miami-Dade County instructions, not United States-wide requirements; check the rules for the exact county or city where the cat was found.

Australian Capital Territory

ACT Government guidance published 1 October 2026 puts safety first, recommends local veterinary microchip scanning when it is safe, and points people to Access Canberra Animal Regulation or RSPCA ACT as needed. The ACT also has its own registration and microchip obligations for cats and dogs. Those requirements describe the Territory and should not be generalized to other Australian states or countries.

Ottawa, Ontario

Ottawa Humane Society guidance says a finder cannot simply keep a found cat and should take steps to locate its owner, including submitting a found-pet report. It also recognizes that outdoor cats may have homes and describes taking a safely contained cat to a local vet for a scan. Check the current municipal procedure as well as the humane society’s instructions.

Irvine, California

The City of Irvine’s found-cat guidance requests a found-animal report and recommends a microchip scan. It asks people to contact the city if the animal is sick, injured or presents a safety concern. This describes Irvine’s municipal program, not the rules for all California cities or counties.

Before adopting a cat you found

Ask the agency or shelter handling the case to confirm that you have completed the steps required where the cat was found. In particular, establish whether the cat has been reported, whether an owner search or holding period is required, who is responsible for that process, and whether the authority considers the cat eligible for adoption. Do not infer that time passing, an unsuccessful social-media post or an empty microchip scan alone makes the cat yours.

Where the local authority determines that a cat is unowned or unclaimed, adoption may be possible. In Victoria, council can advise a finder about adoption after its holding process. The timing and route differ by location, so get the decision and next steps from the authority managing the case rather than relying on a rule from another city or jurisdiction.

How to choose whom to call

The right contact is the animal-control agency, council, municipal animal service or shelter responsible for the precise place where you found the cat. A nearby veterinarian may be able to scan, but call first: not every clinic accepts found animals, and a scan does not replace a required report or transfer to the responsible authority.

  • Ask whether the service scans found cats and whether it accepts them for care or referral.
  • Ask how to file a found-pet report and whether you may temporarily hold the cat.
  • Ask who conducts the owner search and what local holding or reclaim rules apply.
  • Ask what ownership information is checked if a microchip record is missing, outdated or inconsistent with another record.
  • Ask what the authority requires before a finder can adopt an animal that remains unclaimed.

These questions help distinguish three different services that are sometimes conflated: scanning for identification, taking formal responsibility for a found animal, and deciding when it may be adopted. One clinic may offer only a scan; another service may manage reporting, holding and reunification. The local authority can tell you which route applies.
