The eastern or American corn snake (Pantherophis guttatus) is an exotic species that Australian authorities treat as a prohibited invasive or pest animal. Victoria, Queensland, South Australia and New South Wales expressly prohibit possession and related dealings without specific authorisation. Commonwealth import approval does not create a right to keep one as a household pet. If you have found, inherited or been offered a corn snake, do not buy, move, release or handle it; contact the relevant state or territory biosecurity or wildlife authority for instructions.
What “corn snake” means in Australian rules
The animal covered by these rules is the eastern, American or common corn snake, scientifically named Pantherophis guttatus. It is native to the south-eastern United States, not Australia. Australian agencies classify it as an exotic pest or prohibited invasive animal rather than a permitted companion reptile. Agriculture Victoria and other agencies have reported animals turning up in Australia, generally after escapes or deliberate releases associated with illegal keeping.

That identification matters. A harmless-looking small colubrid may be misidentified, and legal treatment depends on the species, not on a seller’s description such as “corn snake,” “red rat snake” or a colour morph. Do not assume that a captive-bred animal, an unusual pattern or a snake bought overseas is exempt.

Is it legal to own a corn snake as a pet?
For an ordinary household keeper, the practical answer is no. Several jurisdictions explicitly ban keeping an American corn snake, and the restrictions generally extend beyond simple possession to importing, moving, breeding, selling, giving away and releasing the animal. A narrow institutional, scientific or other authorised activity may be treated differently, but that is not a pet licence. Anyone with such a proposed activity should obtain written advice from the regulator before acquiring or moving a snake.

Rules can change and are made at both federal and state or territory level. The examples below establish the strong national pattern, but they are not a substitute for checking the current law in the jurisdiction where an animal is located.

Why Australia restricts corn snakes
Biosecurity agencies are concerned about what could happen if a population became established, not merely about whether an individual snake is dangerous to people. National priority-list material describes the corn snake as an emerging invasive species with potential to prey on native rodents, nesting birds, amphibians and lizards. It could also compete with native snakes and other predators and introduce animal diseases.

Those are risk assessments, not proof that every predicted impact has already occurred in Australia. The policy response is preventive: stopping importation and private possession reduces the chance that escaped or released animals survive, reproduce and spread. A snake that seems easy to contain in a terrarium can become a biosecurity incident if it escapes or is deliberately released.
Victoria says government officers detect one to two eastern corn snakes annually, although the published page does not identify the year for that figure. It should therefore be read as an example of recurring detections, not as a current national or state-wide annual rate.
Federal import rules do not make private ownership legal
Australia separates border control from domestic wildlife and biosecurity regulation. The Commonwealth controls the import of live animals and maintains the legal list of specimens suitable for live import. Importers must also meet quarantine and biosecurity conditions. The federal wildlife-trade explanation makes clear that states and territories have their own laws governing the keeping of wildlife within their borders.

Consequently, an import approval, quarantine release or overseas ownership document is not a permit to keep a corn snake at home. A person would need to satisfy both the applicable Commonwealth requirements and the local possession rules, and the local rule may prohibit the species altogether. The relevant federal references are the Department of Climate Change, Energy, the Environment and Water’s wildlife-trade and law guidance, the Federal Register list of specimens suitable for live import and Australian Border Force’s animal-import requirements.

“Owning” is only one part of the legal picture. Before taking any action, distinguish the activity you are considering:
- Acquiring or accepting: Buying, receiving as a gift or taking custody of a snake can be prohibited even when no money changes hands.
- Keeping: Housing the snake in a home, business or collection may itself be unlawful.
- Moving or transporting: Driving it to another property, state or territory can create a separate breach. Queensland and South Australia expressly address movement or transport.
- Breeding: Victoria specifically identifies breeding without an appropriate permit as illegal.
- Selling or transferring: Selling, giving away or otherwise dealing with the animal is prohibited in the jurisdictions that list those activities.
- Feeding or caring for it: Queensland’s prohibition includes feeding. Do not treat temporary care as a safe loophole.
- Releasing: Release is expressly prohibited and creates an environmental risk. Never abandon a snake outdoors or place it in bushland, drains or a park.
Authorisation, where a jurisdiction allows any exception, is fact-specific. Do not rely on a permit issued for a different species, property, purpose or state.

What to do if you see, find or already possess one
Use the following response for a sighting, an escaped animal or a snake that someone has been keeping:
- Do not buy, sell, give away, move or release it. Do not advertise it online or arrange transport to another keeper.
- Keep people and pets away. Close internal doors or block access to other rooms only if you can do so without approaching the snake.
- Do not handle it unless you are trained or a professional snake-catcher. Queensland specifically advises against handling and directs people to contact Biosecurity Queensland.
- Contact the regulator promptly. In Queensland, report it to Biosecurity Queensland using the instructions on its American corn snake page. In another jurisdiction, contact that state or territory’s biosecurity, agriculture or wildlife authority and explain where the animal is, whether it is contained and whether anyone has handled it.
- Follow collection instructions. Authorities may send an authorised officer or professional catcher and tell you what temporary containment, photographs or location details are safe to provide.
When calling, give the exact address or sighting location, date and time, a description or photograph taken from a safe distance, and whether the snake is indoors, outdoors or contained. Do not delay reporting while trying to identify a colour morph.

Moving to Tasmania with a pet snake
Tasmania’s natural-resource guidance states that a person moving or travelling there cannot bring a pet snake. That is a direct practical answer for relocation planning: do not put a corn snake in a vehicle, aircraft, freight consignment or household shipment bound for Tasmania. Contact Tasmania’s fauna-import authority before making arrangements for any snake, because entry rules and permitted species are separate from the law where the animal currently lives.

The Tasmanian page does not establish every detail of possessing a snake that is already on the island. If your situation is more complicated than a planned move, request written advice rather than inferring legality from the transport rule.
What about the ACT and jurisdictions not listed in detail?
The available ACT material establishes a licensing system: animals must be licensed unless they are on an exempt list. It does not, on its own, confirm that a corn snake is exempt or provide a complete species-specific answer. Ask the ACT authority for a written determination before possessing, importing or transferring one.
Likewise, do not interpret the absence of a corn-snake sentence on a webpage as permission in another state or territory. Species lists, invasive-animal schedules and permit rules can be amended. The safest process is to identify the animal scientifically, state exactly what you want to do, and ask the local regulator whether possession, movement, breeding, sale or research is authorised.
Enforcement and why informal advice is risky
Illegal exotic-animal cases can involve more than a warning. Victoria’s guidance states that penalties apply to unauthorised import, keeping, breeding and trading. The National EPA has also reported a person charged over illegal possession of exotic snakes and turtles, illustrating that authorities can investigate private collections rather than treating them as harmless hobby matters. Details of an offence, available defences and penalties depend on the legislation and facts in the relevant jurisdiction; obtain legal advice if you are contacted by an investigator.
Do not rely on a breeder, social-media group, pet-shop employee or overseas permit holder who says a corn snake is “legal somewhere in Australia.” Ask the regulator whose law applies to your address and proposed activity. Keep any written response with your records.
Bottom line for prospective keepers
A corn snake is not a lawful ordinary pet in Australia. Victoria, Queensland, South Australia and New South Wales provide explicit prohibitions, while Tasmania bars bringing a pet snake into the state and the ACT requires species-specific clarification under its licensing framework. Federal import processes do not override those domestic rules. If you encounter one, prevent escape only when safe, avoid handling, and report it immediately to the appropriate authority.
