Usually, not just because the lease says “no pets.” In the United States, a renter may ask for permission to keep a disability-related assistance animal, including an emotional-support cat, as a reasonable accommodation. A housing provider may request reliable information when the disability-related need is not apparent, and may have grounds to refuse in specific circumstances. The outcome depends on the facts and applicable federal, state, and local law.
Can a landlord refuse an emotional support cat?
HUD’s current assistance-animal guidance describes a reasonable-accommodation process under the Fair Housing Act. It identifies permission to live with an assistance animal in housing with a no-pets policy as an example of an accommodation request. A blanket pet rule does not, by itself, answer whether a disability-related request should be granted.

This is not an unconditional right to keep any animal in any rental. The provider may assess the request and the particular cat under the applicable law and circumstances. State and local protections, housing-program rules, and court decisions may also affect a renter’s rights; this federal overview cannot resolve every location-specific dispute.

What makes the request disability-related?
The request is for an accommodation connected to a person’s disability and disability-related need—not simply because a cat is described as an “ESA.” HUD says reliable disability-related information may be requested when both the disability and the need for the animal are not apparent. Its current webpage does not prescribe one universal form or letter format.

A certificate, registration, vest, or online listing does not automatically establish eligibility or guarantee approval. Avoid sharing more private health information than is needed to explain the accommodation request. What information is appropriate may depend on the circumstances and applicable law.
How to request permission for your cat
- Write to the housing provider. State that you are requesting permission to keep the cat as a disability-related reasonable accommodation.
- Explain the connection. Describe, at an appropriate level of detail, how the accommodation relates to your disability-related need. If the need is not apparent, the provider may ask for reliable supporting information.
- Keep a record. Save your request, any supporting information you provide, the response, and related communications. These are practical record-keeping steps, not a HUD-prescribed form or deadline.
- Respond to relevant questions. If the provider raises a concern about this cat, keep the discussion focused on the specific concern and whether an accommodation could address it.
When may a landlord deny the request?
HUD’s current webpage identifies possible grounds for refusing an accommodation. These are fact-dependent, not a blanket license to reject cats or assistance-animal requests generally.

- The accommodation would cause an undue financial and administrative burden.
- It would fundamentally alter the essential nature of the housing provider’s operations.
- This particular animal would pose a direct threat to other people’s health or safety that cannot be reduced or eliminated through another reasonable accommodation.
- The request would result in significant physical damage to others’ property that cannot be reduced or eliminated through another reasonable accommodation.
A general dislike of cats or a no-pets clause is different from an individualized concern that fits one of these grounds. Whether a landlord’s stated reason is legally sufficient depends on the facts and relevant law.

HUD’s current webpage gives waiving a pet fee, deposit, or other rule as an example of a possible accommodation request. The fee question should not be treated as settled solely by relying on HUD’s former detailed notice: that 2020 notice said assistance animals should not be charged pet fees or deposits under its framework, but HUD now lists that notice among withdrawn FHEO guidance documents. Check current federal, state, and local requirements for your situation.

What changed in HUD guidance?
HUD’s detailed FHEO assistance-animal notice, issued January 28, 2020, is no longer current detailed agency guidance: HUD’s Fair Housing Act page lists a notice withdrawing FHEO guidance documents. HUD’s current assistance-animal webpage still describes the general reasonable-accommodation framework, including requests for supporting information when the disability-related need is not apparent. The former notice is historical context, not a current step-by-step HUD rule.
A federal regulatory-agenda entry describes planned rulemaking on assistance-animal accommodation requests, including emotional-support animals. An agenda is forward-looking; it is not itself a final regulation. Do not assume a planned rule is already effective.

What to do if your request is refused
Keep the request, any information submitted, the refusal, and relevant communications. HUD says a person who believes an accommodation was unlawfully denied may file a complaint with its Office of Fair Housing and Equal Opportunity (FHEO); see the complaint information on HUD’s assistance-animal page. For advice about local deadlines, possible defenses, remedies, or state and local protections, contact the appropriate fair-housing agency or a qualified local attorney.
