Dangerous Dogs Act UK: what the evidence says about public safety

Dog-bite and strike admissions in England have risen, but incomplete incident data make it difficult to show whether breed-specific restrictions have improved public safety.

The available evidence does not establish that the Dangerous Dogs Act has failed to reduce attacks—or that its XL Bully ban has made the public safer. It does show that dog-bite and strike hospital admissions in England have risen, while incomplete incident data make it difficult to measure the effect of breed-specific rules. The government says the XL Bully listing was a response to the type’s disproportionate involvement in rising fatal attacks; an independent committee says the evidence was not sufficient to understand the policy’s welfare effects fully.

What does the Dangerous Dogs Act do?

The Dangerous Dogs Act 1991 combines two distinct approaches. Section 1 restricts five specified types: Pit Bull Terrier, Japanese Tosa, Dogo Argentino, Fila Brasileiro and XL Bully. Section 3, by contrast, makes it an offence for a dog of any breed to be dangerously out of control in any place. The general offence is not limited to dogs on the section 1 list.

In the government’s account, a section 3 conviction can have serious consequences, including an order for the dog to be destroyed and, in relevant cases, imprisonment for an owner of up to 14 years. The Act applies in England, Scotland and Wales, although dangerous-dog matters are devolved in Scotland. The specific XL Bully exemption rules described below apply in England and Wales.

Why is the claim that the Act is “failing public safety” hard to prove?

The clearest recent national indicator in the official material is hospital admissions relating to dog bites or strikes in England. The Responsible Dog Ownership Taskforce reports that these admissions rose by 77%, from 6,097 in 2010–11 to 10,787 in 2024–25. Those figures show that recorded serious harm remains a concern; they do not show how many individual bites or incidents occurred, which breeds were involved, or whether a particular law caused the increase. The Taskforce report also notes that aggravated section 3 offences are notifiable, while lower-level enforcement data may be collected inconsistently by individual police forces and councils.

That distinction matters. A rise in admissions cannot by itself establish that the law failed: it does not tell us what would have happened without the law, or whether the rate of harm changed for listed dogs compared with other dogs. Nor does it prove the ban caused the rise. The official sources reviewed here do not provide a causal before-and-after evaluation of the XL Bully policy’s public-safety effect.

Does breed-specific legislation reduce dog attacks?

The available evidence does not settle that question. The Animal Sentience Committee says bites are not required to be reported or recorded consistently and that there is no accurate, reliable database covering all dog bites and strikes. It also identifies gaps in information about triggers, training, experience and other possible causal factors. Without consistent incident and context data, it is difficult to compare outcomes, identify which measures work, or separate the effect of a breed-based restriction from other influences.

The committee concluded that the evidence base did not allow policy makers to fully understand the welfare impact of adding XL Bullies to the banned list. Its finding is a critique of how well the decision and its effects can be assessed; it is not proof that breed never matters or that the ban did not prevent any harm. The committee’s report puts the data problem plainly: “There is no accurate, reliable database to document all dog bites and strikes, so it is not possible to monitor and analyse incidents, or understand all the relevant causal factors.”

Why did the government add XL Bullies to the restricted list?

The government says the XL Bully was disproportionately involved in an increase in fatal attacks and that adding the type to section 1 was intended to protect public safety. That is the government’s stated rationale, not a finding that the ban’s overall effect has since been demonstrated. The Animal Sentience Committee, separately, questioned whether the underlying evidence was sufficient to understand the decision’s welfare consequences. These positions address different questions: the government explains why it acted, while the committee highlights limitations in the evidence and the resulting harms.

In its March 2026 response, Defra reported that more than 57,000 owners had registered dogs through the XL Bully exemption scheme and that compensation had been claimed for 406 euthanised dogs. Defra said the number ultimately registered exceeded its initial estimate, creating a greater welfare burden than anticipated. It described the exemption scheme as “an important enforcement tool for the protection of public safety in cases of non-compliance”; that statement explains the government’s view of enforcement, but is not evidence that the ban reduced attacks. What are the welfare and enforcement concerns?

The Animal Sentience Committee identifies seizure, prolonged kennelling while officials assess a dog’s type, and lifelong behavioural restrictions as direct welfare harms. It also reports stakeholder concerns about the quality of dog-incident data. Those impacts sit alongside the stated public-safety purpose: evaluating a restriction requires considering its safety effects as well as the consequences for dogs, owners and enforcement services.

The scale of registrations exceeding the government’s initial estimate is one example of how implementation can carry a larger burden than expected. The sources establish that this happened; they do not quantify every cost to owners, councils or police, or show that the same burden would arise under any alternative policy.

What could a stronger public-safety approach measure?

The Responsible Dog Ownership Taskforce discusses options beyond breed lists, including better recording and sharing of incident data, more consistent enforcement guidance, preventative enforcement, education and possible owner-licensing approaches. It reports no consensus on a single licensing design and says further evaluation is needed before adopting one. These are policy options, not proven substitutes for the current law.

Policy question Breed- or type-based restriction Conduct, prevention and owner-focused measures
What is the focus? A dog’s classification as one of the specified types. An individual dog’s conduct and risk, owner responsibilities, early intervention and prevention.
What would help assess its effect? Consistent incident records that identify dogs’ types and allow outcomes to be compared. Consistent records of incidents, circumstances, enforcement and interventions, so outcomes can be assessed across cases.
What trade-offs need examination? Public-safety aims alongside welfare consequences, enforcement demands and the burden on owners. How reliably measures can be delivered, enforced and evaluated, including whether preventative action reduces escalation.

The table describes questions that matter when comparing policy options; it does not imply that current evidence has answered them. The Taskforce reports that lower-level enforcement data are not collected consistently everywhere, and the committee describes wider gaps in bite reporting. Better information would make it more possible to test whether a measure improves safety and at what cost.

The Taskforce also discusses training and behaviour support, but warns that “trainer” and “behaviourist” are unprotected titles and that professional competence varies. Anyone seeking help should check a provider’s qualifications and use of humane methods rather than assuming the job title guarantees regulation or effectiveness. The report quotes the National Police Chiefs’ Council lead for dangerous dogs as saying “the bigger picture is a focus on responsible dog ownership”.

What are the current XL Bully rules in England and Wales?

As of Defra guidance last updated 1 October 2026, an exempt XL Bully must be kept securely and must be on a lead and muzzled in public, as well as continuing to meet the other conditions on its certificate. Defra recommends a muzzle that does not inhibit panting, breathing or drinking. A muzzle is one requirement; it does not itself make a dog exempt.

  • Third-party public-liability insurance is no longer required for banned-breed dogs from 1 July 2026.
  • From 1 November 2026, an adult must supervise a child under 12 in close contact with an XL Bully in a private place. This requirement is due to begin after the 1 October guidance update.
  • General exemption applications have closed. Defra says a new exemption can now be authorised only by court order.

So, is the Dangerous Dogs Act failing public safety?

There is evidence of continuing serious harm: the Taskforce reports a substantial rise in dog-bite and strike hospital admissions in England over the period it measured. But the available figures do not establish that the Act or XL Bully ban failed to prevent harm, caused the rise, or reduced attacks. Inconsistent reporting and limited context make those effects difficult to judge. A defensible criticism is that the current evidence base is too weak to evaluate breed-specific policy robustly, while the XL Bully restrictions have brought welfare consequences and a larger-than-estimated population into enforcement.
