Usually, birds do not reuse the exact nest. Most small songbirds abandon a nest after their young leave and build a fresh one for the next brood. Reuse does happen, but it is concentrated in particular species, nest designs and habitats: eagles and ospreys may repair the same stick platform for years, cavity nesters may return to an old hole, and some birds occupy nests built by other species.
A bird returning to the same yard, tree or territory is not necessarily returning to the same nest. That distinction—nest-site fidelity versus nest reuse—explains many apparently conflicting observations.

What “reuse” can mean
Birders use “reuse” for several different behaviors, and separating them prevents mistaken conclusions.

Repairing an old structure
Some species add new twigs, grass, moss or feathers to a partly deteriorated nest. Broad-tailed Hummingbirds, for example, sometimes reuse a previous-season nest by adding fresh material. That is renovation, not simply moving into an untouched old cup.
Returning to the same site but building anew
A pair can come back to the same branch, cliff, nest box or territory and construct a completely new nest. Cornell Lab ornithologists describe this as area or site fidelity, which is different from reusing the old nest.
Using a cavity or another bird’s nest
A cavity nester may return to the same hole after another bird has used it, while a species that does not build its own nest may occupy a structure made by a different species. These are forms of reuse even though the bird did not construct the original nest.

1Repair Windows errors before they cause bigger problems2Scan for outdated or missing drivers - takes under a minute3Clear out junk files and repair common Windows errorsWhy most birds abandon the exact nest
A nest is generally a temporary cradle for eggs and helpless young, not a permanent home. Audubon’s natural-history guidance notes that a few species, including some wrens, use nests as nighttime shelters, but they are exceptions. For most birds, once the young are capable of leaving, the nest is abandoned and usually never used again.
Predators can learn a known location
Predation is a major reason for starting over. Cornell ornithologists explain that returning to a known nest location can make it easier for predators to find the next brood. A fresh nest in a new position may reduce that predictable risk, especially for small birds whose open-cup nests are exposed.

A new nest can be cheaper than maintaining a dirty one
After a brood leaves, the structure may contain feces, food remains, parasites and damp nesting material. Building elsewhere avoids carrying that material into a new clutch. The exact balance varies by species, weather and available building supplies, but the common pattern is clear: small open-cup songbirds usually build again rather than occupy the old cup.
Construction is part of the breeding strategy
Nest building also allows a pair to choose a safer height, denser vegetation or a better-supported branch. A bird that returns to the same territory can keep the benefits of a familiar feeding area while changing the nest’s precise location.

Returning to a territory does not prove nest reuse
Many birds show strong fidelity to a territory or nesting area. The same pair—or one member of it—may return to a familiar patch because it offers food, cover and a suitable mate. They may even use the same tree or nest box while replacing the nest itself.
To establish actual reuse, observe whether adults carry new material into the old structure, whether eggs are laid in that structure, or whether the old nest has been removed and replaced. A bird seen near an old nest is not enough evidence: it may be inspecting the site, defending the territory or beginning construction nearby.
Species and nest types that commonly reuse
Reuse is most likely when a nest is difficult to build, when suitable sites are scarce, or when the structure is large and relatively safe from predators.

Large stick nests: eagles and ospreys
Large raptors such as eagles and ospreys often repair and enlarge the same stick platform over multiple seasons. Their nests can become substantial structures because the birds are large enough that a predator finding the platform is less dangerous than it would be for a small songbird. Annual additions may produce a nest that weighs far more than the original construction.

Woodpecker-made holes and natural cavities take time to excavate and are limited in many habitats. Reusing a suitable cavity can therefore save substantial effort without exposing eggs in an open cup.
A measured example comes from Acorn Woodpeckers at Hastings Reservation in central coastal California. A peer-reviewed study published in 2021 found that 57.2% of nests reused old cavities. The study detected no significant fitness cost or benefit compared with newly constructed cavities, suggesting that access to usable cavities and the difficulty of making new ones can matter more than a universal advantage to reuse.
Merlins: occupants of other birds’ nests
Merlins do not build their own nests. Cornell reports that they use old nests made by crows, ravens, magpies or hawks, usually making few modifications. This is nest reuse by adoption rather than by returning to a nest the merlin built itself.
Eastern Kingbirds: occasional use of another species’ nest
At Malheur National Wildlife Refuge, an experimental study published in 2013 found that about 10% of female Eastern Kingbirds reused old nests, mainly American Robin nests. The work examined whether a shortage of suitable nest sites could encourage this behavior. That figure describes the females and conditions in that study site; it is not a percentage for all kingbirds or all birds.

Broad-tailed Hummingbirds: reuse with fresh material
A female Broad-tailed Hummingbird sometimes reuses a nest from a previous season, adding new fibers and other material to what remains. Because hummingbird nests are tiny and delicate, renovation may be practical when the supporting branch and surrounding conditions are still suitable.
Wrens and nighttime shelter
Some wrens may sleep in old nests even when they do not use them for another clutch. Seeing a bird enter an empty nest after dark therefore does not necessarily mean breeding reuse.
How the main examples compare
| Example | Nest structure | What is reused | Evidence or rate | Likely constraint |
|---|---|---|---|---|
| Eagles and ospreys | Large open stick platform | Their own nest, repaired and enlarged | Documented multi-season reuse | High construction effort; lower relative predation risk |
| Acorn Woodpeckers | Enclosed tree cavity | Old cavity | 57.2% of nests at Hastings Reservation, 2021 study | Limited suitable cavities |
| Merlins | Open stick nest | Nests built by crows, ravens, magpies or hawks | Species account documents regular use | No nest construction by merlins |
| Eastern Kingbirds | Open cup | Mostly old American Robin nests | About 10% of females at Malheur National Wildlife Refuge, 2013 study | Possible shortage of nest sites |
| Broad-tailed Hummingbirds | Small open cup | Previous-season nest, with added material | Occasional behavior documented by Cornell | Suitable support and a usable remnant |
These examples cannot be averaged into one “bird reuse rate.” No universal percentage applies across all birds; rates are species- and site-specific.

A pair may raise more than one brood in a breeding season. If it builds a second nest after the first brood fledges, that is a new nesting attempt, not proof that the first nest was reused. Small birds often choose a different location for the second attempt, although the same territory may be retained.
Reuse across years is a separate question. It is most plausible when the nest is a durable platform, a protected cavity or a structure that would be costly to recreate. When observing a nest in spring, compare photographs or other records from the previous year before calling it the same nest; wind, rain and nest additions can make separate structures look alike.

What to do when you find an apparently abandoned nest
An empty nest may be finished, temporarily unattended or still part of an active nesting area. Adults can be away feeding, and fledglings may be nearby but out of sight. One brief observation cannot establish abandonment.
Watch without approaching
- Keep your distance and observe for several hours, preferably from indoors or behind existing cover.
- Look for adults carrying food or nesting material, but do not repeatedly approach to provoke a response.
- Check the surrounding shrubs, ground and low branches for recently fledged young; parents may be caring for them away from the nest.
Never disturb an active nest
Leave any nest containing eggs, chicks or dependent young exactly where it is. Do not touch the eggs, move the nest, prune the supporting branch or clean out the structure while it is in use.
Is it legal to remove a bird nest?
In the United States, the Migratory Bird Treaty Act protects covered migratory birds, their nests and eggs. U.S. Fish and Wildlife Service guidance states that no person may take, possess, import, export, transport, sell, purchase or barter a migratory bird—or its parts, nest or eggs—except under a valid permit. The agency specifically says destroying a nest with eggs, chicks or dependent young is illegal unless an applicable permit authorizes it.
Rules can vary by species, state, timing and the status of an empty nest. If a nest is attached to a building, vehicle or equipment and creates a safety problem, contact your state wildlife agency or the U.S. Fish and Wildlife Service before removing it. Do not assume that an apparently unused nest is automatically unprotected.
How to support birds that use cavities
A properly installed nest box can provide a limited nesting resource for cavity-nesting birds, according to Cornell guidance. A box is not a guarantee of occupancy: species, entrance-hole size, placement, habitat, competition, predators and local regulations all affect whether a bird uses it.
- Choose a box designed for species native to your area.
- Install it at the height and habitat recommended for that species, with a clear flight path.
- Use predator-conscious mounting and keep cats and other predators away from the entrance.
- Follow local wildlife guidance on cleaning and seasonal inspection; never open a box containing eggs or young.
The practical answer for birders
Assume that a small bird’s old open-cup nest is a one-use cradle unless you have evidence otherwise. Expect some birds to return to the same territory while building a new nest. Treat large raptor platforms, cavities and adopted nests as the main exceptions, and remember that the documented percentages—57.2% for Acorn Woodpecker cavity nests in one California study and about 10% for Eastern Kingbird females at one refuge—describe particular species and places, not birds in general.
