The correct appeal route and deadline depend on what decision was made; there is no single deadline for every case.
First identify exactly what decision was made
A police officer or local-authority dog warden may arrange for a suspected dog to be seized and assessed by an expert. That expert’s identification is not itself the same thing as a court finding, a conviction, or an order to destroy the dog. The process may move from suspicion and assessment to prosecution and a court decision. Check your paperwork to establish which stage you are at. GOV.UK’s guidance on banned dogs describes seizure and assessment; CPS guidance explains that the court decides whether the dog is a prohibited type.
- Initial identification: An expert has assessed the dog as appearing to be a prohibited type, but there may not yet have been a court decision.
- Allegation or charge: The prosecution alleges that the dog is prohibited. This is not yet the same as a conviction or final order.
- Court finding or conviction: The court has decided the prohibited-type issue, or convicted someone of an offence. Check whether the decision also includes a sentence or other order.
- Destruction, disqualification, or exemption-related order: The court has made a specific order. The route for challenging that order may differ from a challenge to the finding or conviction.
Ask for the written notice, charge or prosecution papers, expert identification report, court decision, and any order. If you do not have them, ask the police, council, prosecutor, or court handling the case how to obtain the relevant documents.
Understand what “prohibited type” means
The law is concerned with a dog’s type, not simply its pedigree or the name used for it. GOV.UK says: “Whether your dog is a banned type depends on what it looks like, rather than its breed or name.” Its list comprises Pit Bull Terrier, Japanese Tosa, Dogo Argentino, Fila Brasileiro, and XL Bully. The XL Bully rules have jurisdiction-specific exemption arrangements.

The CPS describes “type” as wider than breed. For Pit Bull Terrier cases, its guidance refers to an approach based on a substantial number of characteristics; the court decides the factual question. Where the prosecution alleges that a dog is prohibited, the CPS says the statutory presumption is that it is prohibited unless the defendant shows otherwise. GOV.UK likewise says the owner is responsible for proving that the dog is not a banned type.
That makes the actual issue in the case important: evidence needs to address the characteristics the court is being asked to assess. A breed name on paperwork does not settle the legal question, and the official sources do not establish a DNA test as a substitute for the type assessment.

Match the challenge to the decision and jurisdiction
Do not assume that every expert identification has a standalone appeal, or that a challenge to a conviction follows the same procedure as an appeal against a destruction order. Confirm whether the case is in England and Wales, Scotland, or Northern Ireland, which court acted, and what remedy you need.

The statutory wording and limits matter. Read section 4 of the Dangerous Dogs Act 1991 alongside the precise order. It gives a right of appeal to the Crown Court to an owner who was not the offender against a destruction order made in the circumstances set out there. For that defined appeal in Scotland, the Act specifies seven days, with the appropriate appeal court depending on whether the conviction followed summary procedure or indictment. Do not apply that period to a different appeal or jurisdiction without legal advice.

The Act also generally prevents destruction before the relevant appeal period has expired and, if an appeal is brought in time, before it is decided or withdrawn, subject to the statutory terms. Check the exact order and obtain advice rather than assuming the protection applies to every situation.
Get urgent, case-specific advice
- Collect the papers. Request the written decision and order, the charge or prosecution papers, and the expert identification report. Note the date of each decision and when documents were served or received.
- Confirm the route. Ask a solicitor familiar with the relevant dog-law and appeal process which decision can be challenged, in which court, whether permission is required, what deadline applies, and what form or procedural step is needed.
- State the remedy you seek. Explain whether you want to challenge the prohibited-type finding or conviction, change a sentence or order, prevent destruction, or pursue an available conditional exemption route. These are distinct objectives.
- Discuss evidence against the legal test. For a type question, ask what material addresses the dog’s physical characteristics. For a public-safety assessment, ask what evidence bears on the dog’s temperament and past behaviour and whether the owner or person in charge is fit and proper.
- Act on the advice without delay. Do not wait for a general online guide to calculate a criminal appeal deadline. If you are unsure where to start, contact a solicitor, law centre, or advice agency promptly.
GOV.UK’s page on appealing a civil or family decision says that appeals need proper legal grounds and advises acting quickly. It is general civil guidance, not the procedure or deadline for a criminal Dangerous Dogs Act case.

A prohibited-type finding and public-safety decision are different
A court can have to decide both whether a dog is a prohibited type and what order is appropriate. Under section 4 of the Act, for the statutory public-safety assessment the court must consider the dog’s temperament and past behaviour, and whether the owner or person in charge is fit and proper. It may also consider other relevant circumstances. Those questions are not interchangeable: evidence about public safety does not, by itself, answer whether the dog is of a prohibited type.
In England and Wales, the Dangerous Dogs Exemption Schemes Order 2015 provides a certificate route in specified circumstances where a court finds the dog is not a danger to public safety and makes a contingent destruction order. The scheme has conditions, and neither such an order nor an exemption should be treated as automatic.
