What to Do If Your Dog May Be a Restricted Breed

Find out what to do if your dog may be a restricted breed: secure them, check the exact local rules, preserve records and seek qualified advice—especially if an authority has contacted you.

Keep your dog safely contained and under control, then check the law where you live before making decisions. “Restricted breed” is not a universal legal category: the breeds or physical types covered, exemptions, deadlines and enforcement procedures differ by jurisdiction. If an authority has contacted you, follow its instructions and promptly seek advice from a qualified local dog-law professional.

What to do first

  1. Keep your dog secure. Prevent escapes and follow any safety directions already given by an authority. Do not assume a breed label alone tells you what rules apply.
  2. Identify the exact jurisdiction. Write down your country and, as relevant, your state or province and city or local authority. Check current official government and animal-control guidance for those places; national rules may not be the only rules that apply.
  3. Preserve records. Gather adoption or purchase papers, veterinary records, microchip details, photographs, prior assessments and all official correspondence. Keep a dated record of calls and messages, including the names and roles of people you speak with.
  4. Get qualified local advice. Contact the relevant animal-control authority or a dog-law solicitor or adviser. If you have received a notice, your dog has been seized, or a hearing is pending, treat the matter as time-sensitive and ask about deadlines and the next required step.
  5. Check insurance and housing separately. Ask your insurer and housing provider what their own policy or tenancy terms require; do not infer coverage or tenancy rights from a general online summary.

While you verify the rules, do not abandon, sell, give away or breed the dog. The UK government says those acts are unlawful for a banned dog in the UK; other jurisdictions may define their rules differently. Contact the appropriate authority or a local dog-law professional rather than casually transferring the dog.

How to find out whether your dog is legally restricted

Start with official sources for your location, including the relevant government and animal-control pages. Look for the exact legal wording, which dogs or physical types it covers, any exemption process, deadlines, and what happens after an authority raises a concern. Insurance, housing and local animal-control policies may also impose separate requirements, so check those with the organizations that administer them.

Do not treat a breed name on adoption paperwork, an informal opinion, or a DNA result as a legal determination. Preserve those materials as part of the record, but ask the competent local authority or a qualified local adviser how classification is made under the law that applies to you.

What the UK example shows—and what it does not

UK rules illustrate why location matters; they do not apply everywhere. GOV.UK lists Pit Bull Terrier, Japanese Tosa, Dogo Argentino, Fila Brasileiro and XL Bully among banned types, and says: “Whether your dog is a banned type depends on what it looks like, rather than its breed or name.” The same guidance describes police or council seizure and court procedures, and says the owner is responsible for proving that the dog is not a banned type. For England and Wales, GOV.UK says a person cannot own an XL Bully without a valid Certificate of Exemption. Its current guidance describes conditions including neutering, microchipping, secure keeping, and keeping the dog on a lead and muzzled in public. It says public liability insurance is no longer required from 1 July 2026. From 1 November 2026, a child under 12 must not be left in close contact with a banned dog in a private place without adult supervision. Scotland and Northern Ireland have separate rules and guidance. Do not assume the England and Wales exemption conditions or dates apply there. The statutory instrument page for the England and Wales exemption scheme displays an older version containing insurance language; for the stated 2026 insurance change, use the later GOV.UK guidance above rather than treating that older text as current. If an authority has contacted you

Read the notice carefully and establish who issued it, what action it requires, and any response date or hearing date. Contact the authority promptly to clarify procedural questions, and get local legal advice about the classification and your options. Do not ignore correspondence or assume that a conversation replaces a formal response.

In England, official enforcement guidance identifies a Dog Legislation Officer as a specialist in dog law and banned-dog identification. Some local-authority guidance advises owners to seek that officer’s advice when classification is uncertain. These are UK-specific routes; elsewhere, ask the relevant local authority which official or qualified professional handles the issue. England dog enforcement procedures and Southwark Council guidance on banned dogs.

UK guidance says a dog may be seized and held in kennels, with court proceedings possible. If an authority alleges your dog is a banned type, follow its instructions and get advice promptly; the guidance places responsibility on the owner to prove the dog is not a banned type. Insurance and housing questions

Breed-related insurance restrictions exist, but practices and policy wording are not uniform. The U.S. National Association of Insurance Commissioners describes breed-specific insurance restrictions and difficulty identifying breeds; that is a U.S. insurance context, not a universal rule. Ask your own insurer whether the dog affects eligibility, exclusions, liability coverage or any duty to disclose a change. Ask your landlord, housing provider or homeowners’ association directly about applicable terms. NAIC: homeowners insurance and dog-bite liability.
