Illegal-to-Own Animals in America: How Federal, State, and Local Bans Work

An animal may be banned from import without being illegal to own nationwide. This guide explains how APHIS, CDC, wildlife agencies, states and local governments regulate possession, entry, movement, sale and exhibition, with qualified tortoise and hedgehog examples and a verification checklist.

There is no single federal list of every animal that is illegal to own in the United States. Whether you may keep an animal depends on the exact species or subspecies, your state, county and city, and what you plan to do with it. Possessing an animal at home, importing it from another country, moving it across a state line, selling it, exhibiting it, and transporting it can all be governed by different rules.

USDA Animal and Plant Health Inspection Service (APHIS) regulates particular animals and activities, especially international imports and animal-disease risks. States and territories write their own entry and animal-health requirements, while local governments may prohibit or restrict exotic and wild animals. A federal import restriction therefore does not automatically mean that private ownership of the same animal is banned nationwide.

Why “illegal to own” is not one nationwide category

When someone asks which animals are banned in America, they may mean several different legal questions:

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  • Possession: May you keep the animal where you live?
  • Import: May the animal enter the United States from another country?
  • Interstate movement: May you bring it from one state to another?
  • Sale or transfer: May you buy, sell, breed, or give it to another person?
  • Exhibition or commercial use: May you display it, use it in a business, or operate a public attraction?
  • Transport: May you move it through a jurisdiction, even if you do not keep it there?

Each activity can have a separate permit, health certificate, quarantine rule, or prohibition. A rule that blocks entry from a particular country is not the same as a rule that makes possession a crime in every state. The legal answer must identify the jurisdiction and the activity before it labels an animal “banned.”

APHIS states that “Animals entering the United States may be regulated by multiple Federal and State agencies.” In practice, a person bringing an animal into the country may need to satisfy APHIS, the Centers for Disease Control and Prevention (CDC), the U.S. Fish and Wildlife Service, state authorities, and local officials. The importer is responsible for meeting all applicable requirements.

What the federal government regulates

APHIS Veterinary Services and international entry

APHIS Veterinary Services focuses on animals and activities connected to animal health, agriculture, and disease prevention. Its import guidance covers categories including livestock and poultry, certain fish and aquatic species, pachyderms, hedgehogs and tenrecs, certain dogs, certain tortoises, and zoological ruminants. The agency also explains that Veterinary Services does not regulate the import of many other animals under its own authority; another federal or state agency may still regulate them.

Import conditions can change with the animal’s species, subspecies, country of origin, disease status in that country, travel route, and intended purpose. Depending on those facts, an applicant may need an APHIS permit, an official veterinary health certificate, inspection, testing, or quarantine. A shipment that is acceptable from one country may be refused from another, and a rule for a zoo or research institution may not apply to a private pet owner.

Other federal agencies

APHIS is not the only federal authority. CDC rules can address animals that present human-health risks, while the U.S. Fish and Wildlife Service can regulate wildlife imports, endangered species, protected species, and international trade. Fish, marine mammals, birds, and other wildlife may also fall under additional federal statutes or agency programs. Meeting an APHIS requirement does not by itself authorize an import that another agency prohibits.

Federal import limits are not a national ownership list

Federal pages often use terms such as “prohibited,” “restricted,” or “not eligible for entry.” Those terms describe the border or a regulated activity. They do not, without more, establish that every private owner in every state is committing an offense by possessing the animal. To determine ownership legality, you must check the law of the place where the animal will be kept and any rules governing its acquisition or movement.

State, territory, county, and city rules

States set receiving-jurisdiction requirements

APHIS explains that each receiving state or territory writes and maintains its own requirements for live-animal entry. Those requirements can include health certificates, tests, identification, prior notification, permits, or outright exclusions. A state may allow an animal to be kept by a resident but refuse entry from another state unless conditions are met. Another state may prohibit private possession altogether or allow it only for a licensed facility.

Local ordinances can be stricter

Counties and cities may add exotic-animal, public-safety, zoning, or nuisance rules. A state permit does not necessarily override a city ban, and a city license does not legalize an animal that state law prohibits. Local codes may also restrict the size, number, enclosure, insurance, or escape-prevention measures required for an otherwise lawful animal.

Why a national list is unreliable

The available federal guidance does not provide a complete, current inventory of every possession prohibition in every state, county, and city. Laws can distinguish between species that look similar, change after disease outbreaks, and use different definitions for “wild,” “exotic,” “dangerous,” or “domesticated.” A list copied from an old website can therefore be wrong for your address, your animal’s scientific name, or the activity you intend.

Examples that are often misunderstood

Tortoises listed as prohibited by APHIS

APHIS identifies several tortoise species among those prohibited in the context of its import rules:

  • Leopard tortoise (Stigmochelys (Geochelone) pardalis)
  • African spurred tortoise (Centrochelys (Geochelone) sulcata)
  • Bell’s hingeback tortoise (Kinixys belliana)

This identification does not establish a nationwide ban on private ownership. It means the animals are treated as prohibited for the relevant APHIS import purpose. A person considering one must separately verify the destination state’s entry and possession rules, local ordinances, and any wildlife or conservation requirements.

Hedgehogs and tenrecs

APHIS says hedgehogs that have been in countries affected by foot-and-mouth disease may not enter the United States. It also says hedgehogs and tenrecs from New Zealand are prohibited from entering. These are import rules tied to origin and animal-health concerns, not a declaration that every hedgehog or tenrec is illegal to possess in every state.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

APHIS names Georgia, California, Hawaii, Pennsylvania, Washington, D.C., and New York City’s five boroughs as places where some states or municipalities prohibit import of these animals. The examples are not an exhaustive current list of every possession or entry restriction. A resident must confirm the exact rule with the relevant state and local authority, including whether the rule concerns import, possession, sale, or only a particular species.

Why the scientific name matters

Common names can cover multiple species with different legal status. “Tortoise,” “hedgehog,” or “parrot” may be too broad for a permit application or ordinance search. Use the animal’s scientific name, subspecies where applicable, country of origin, and captive-bred or wild-caught status when asking an agency for a determination.

Compare the legal activity before deciding an animal is banned

Question Authority that may apply What can change the answer
Can I keep it at home? State, county, and city law; sometimes federal wildlife law Species or subspecies, dangerous-animal definitions, zoning, enclosure, permit class, and grandfathering
Can it enter the United States? APHIS, CDC, U.S. Fish and Wildlife Service, and other federal agencies Country of origin, disease status, route, documentation, inspection, quarantine, and purpose
Can I bring it to another state? Receiving state or territory, plus federal rules for the movement Health certificate, testing, prior notice, destination restrictions, and whether the move is personal or commercial
Can I sell or transfer it? State and local wildlife, agriculture, and business rules; federal wildlife or endangered-species rules where applicable Captive-bred status, interstate sale, protected status, dealer licensing, and transaction records
Can I display or exhibit it? State and local licensing, zoning, public-safety rules, and potentially federal animal-welfare or wildlife requirements Commercial purpose, audience access, facility standards, insurance, and permit conditions

If any one of these activities is prohibited, changing the wording from “own” to “transport” or “import” does not make the conduct lawful. Conversely, a restriction on one activity does not automatically prohibit all others.

How to verify whether your animal is legal

Use this process before paying for an animal, signing a transport agreement, or bringing it across a border. Written confirmation is safer than relying on a breeder, social-media post, or an outdated list.

  1. Define the animal precisely. Record the scientific name, subspecies, age, sex, captive-bred or wild-caught status, country of origin, and any hybrid designation. Ask for documents that support those details.
  2. Define the activity. State clearly whether you will possess, acquire, import, move interstate, sell, breed, exhibit, or transport the animal. Mention whether the move is personal, commercial, educational, or for a zoo or research facility.
  3. Check the destination state or territory. Start with the official agriculture, animal-health, wildlife, or natural-resources agency for the place where the animal will arrive. APHIS directs users to state and territory requirements and state animal-health officials.
  4. Check the county and city code. Search the local government’s current code for exotic animals, wild animals, dangerous animals, zoning, animal-control permits, and enclosure requirements. Ask animal control or the clerk which provision applies to the scientific name you supplied.
  5. Check federal agencies for international movement. For an international shipment, review APHIS requirements and contact CDC and the U.S. Fish and Wildlife Service when the species or activity falls within their jurisdiction. Ask whether a permit, health certificate, inspection, testing, or quarantine is required.
  6. Confirm the effective date and conditions. Request the current form, regulation, or written determination. Verify expiration dates, renewal duties, microchip or identification rules, inspection schedules, and what happens if the animal escapes or dies.
  7. Keep a compliance file. Save permits, health certificates, import authorizations, receipts, transport records, and the names and dates of officials who answered your questions. Give copies to the transporter and anyone who may care for the animal.

Do not move the animal while an agency is still deciding. A permit application is not the same as permission, and a document issued for one state, facility, species, or purpose may not transfer to another situation.

Common mistakes and how to avoid them

Confusing import with possession

An animal can be barred from entering the country from a particular origin yet be lawful to possess under a state’s domestic rules if it was already legally present. The reverse can also occur: an animal may clear a federal import process but be prohibited at the destination address. Check both layers.

Relying on a neighboring state’s rule

Permission in one state says nothing about the receiving state. Interstate movement is governed by the destination jurisdiction’s requirements, and local law may be stricter still.

Using a common name only

Officials may issue different answers for species that share a common name. Scientific identification prevents you from receiving a permit for the wrong animal or overlooking a restriction on a close relative.

Assuming a permit makes every use lawful

A permit may authorize possession but not breeding, sale, public exhibition, or interstate transfer. Read the conditions and obtain separate approvals when the activity changes.

Treating an old web list as current law

Disease classifications, local ordinances, and permit programs change. Confirm the rule with the regulator that enforces it and ask when the cited provision took effect.

What to do if you already have a restricted animal

Do not release it. Releasing a non-native or prohibited animal can harm ecosystems, spread disease, and create additional legal violations. Secure the enclosure, prevent contact with other animals, and contact the state wildlife or animal-health authority for lawful options. Depending on the jurisdiction, officials may direct you to a permitted rescue, sanctuary, veterinarian, or surrender program. Ask for written instructions before transferring the animal, and disclose its complete origin and health history.

If the animal was imported or transported without required authorization, consult the relevant agency promptly rather than attempting another move. Keep all purchase, transport, and veterinary records; do not alter identification documents or misstate the species.

A practical decision rule

You can treat an animal as legally cleared only when all of these questions have a documented “yes” or “not applicable” answer:

  • Is this exact species or subspecies identified correctly?
  • Does the state or territory allow the planned possession and entry?
  • Does the county and city allow it at the specific address?
  • Are required permits, health certificates, inspections, tests, and quarantines complete?
  • Are import, interstate movement, sale, breeding, exhibition, and transport rules satisfied for the actual activity?
  • Have all relevant federal agencies been checked for an international shipment or protected species?
  • Are the permissions current and valid for the animal’s origin, destination, route, and purpose?

If one answer is unknown, pause the transaction and ask the enforcing authority. That is the only dependable way to distinguish an animal that is genuinely illegal to keep from one that is merely subject to a conditional entry or permit rule.
