An emotional support animal (ESA) letter is not a universal access pass. Before paying a letter service, decide what you need help with—housing, clinical care, or another specific situation—and check what the service’s clinician will actually assess. Federal rules differ by setting, and HUD’s current housing-enforcement approach changed in 2026.
What an ESA letter service can—and cannot—do
A legitimate clinical service may assess whether an animal is relevant to a person’s disability-related needs and, where appropriate, provide documentation for a specific purpose. A document alone does not establish that an animal qualifies for public access or air-travel rights, and buying a certificate, registration, ID card, vest, or tag does not itself create those rights.
No service can responsibly promise that a landlord, airline, or other organization will accept a document in every situation. The federal sources discussed here do not verify or endorse any commercial letter provider.
Start with the setting: housing, public places, or air travel

What changed in HUD’s housing guidance
September 17, 2025: withdrawal of earlier guidance
HUD’s Office of Fair Housing and Equal Opportunity (FHEO) withdrew its 2013 and 2020 assistance-animal notices from active use. The withdrawal notice says those documents “should not be relied upon as authoritative” while HUD reviewed them. HUD’s older assistance-animals webpage remains online and describes emotional support animals in housing; read it in light of the later withdrawal and enforcement memorandum rather than as a complete statement of current HUD policy.

May 22, 2026: FHEO enforcement memorandum
HUD’s memorandum directs FHEO to find reasonable cause and recommend charges only in animal-accommodation cases involving animals trained to provide disability-related assistance. It is an agency enforcement position, not a final regulation or a court ruling that automatically decides every tenant–landlord dispute. The memorandum says it does not address HUD complaints under Section 504 or the ADA, leaves private federal or state court actions available, and announces intended notice-and-comment rulemaking; it does not establish that a final rule has been issued. HUD also says that over 20% of FHEO fair-housing complaints revolve around untrained ESAs; that is HUD’s figure in the memorandum, which does not provide a separate dataset or calculation.
How to assess an ESA letter service
Evaluate the actual clinical process and the service’s claims, not the appearance of its paperwork. These are practical screening questions, not a list of requirements that apply identically in every state.

- Define the purpose. Tell the service whether you are seeking clinical care, housing documentation, or something else. Ask what the provider can and cannot assess for that purpose.
- Identify the clinician. Ask who will evaluate you, what professional license they hold, and whether they are licensed in the state where you live. Confirm the clinician’s identity and credentials independently.
- Ask how the assessment works. Find out whether it includes an individualized clinical conversation, what information is considered, and whether follow-up care is available. Be cautious if a service appears to sell approval without meaningfully evaluating your circumstances.
- Read the terms before paying. Review the fee, delivery and refund terms, privacy policy, and how records are handled. Check whether the service limits what its letter claims to establish.
- Compare claims with the relevant rules. Treat “instant approval,” guaranteed acceptance, universal registration, or claims that a letter grants public access or airline rights as warning signs unless they are supported by the rules for your specific setting.
Do not misrepresent a diagnosis, disability-related need, animal’s training, or relationship with a clinician. A provider’s willingness to sell a document is not proof that the document fits your situation.
If you are seeking housing accommodation
HUD’s May 2026 memorandum describes how FHEO will assess enforcement complaints; it does not settle every FHA dispute. The memorandum itself says private court actions remain available, and the federal sources cited here do not map state statutes, local ordinances, or all controlling case law. If the facts are contested, consult a local fair-housing organization or a qualified attorney rather than assuming that either an online letter or HUD’s enforcement position resolves your specific case.

- Make your accommodation request and keep the housing provider’s response in writing.
- Keep copies of relevant correspondence and any clinical documentation you choose to provide.
- Seek local, jurisdiction-specific advice if the provider denies or disputes the request.
Do you need to register an emotional support animal?
A commercial registration, certificate, ID card, vest, or tag does not itself establish federal service-animal status or guarantee a housing accommodation. Under the ADA, covered entities cannot require online certification or registration paperwork as an entry condition for a service animal; the ADA definition instead turns on a dog’s individual training to perform disability-related work or tasks. The DOJ FAQ explains that animals providing comfort through their presence alone do not qualify under that definition.
