The incident became widely known because the footage appeared to show him deliberately trying to touch—or “body slam”—a killer whale. The official account does not report that he was seriously injured, attacked, or that the orca was harmed. It does show an extremely risky attempt to get close to a protected marine mammal.
What happened in the video?
In February 2024, the man jumped from a pleasure boat into the water near an adult male orca swimming off Devonport, Auckland. A calf was also in the area.

New Zealand’s Department of Conservation (DOC) said the footage appeared to show a deliberate attempt to touch or “body slam” the orca. Afterward, the man reportedly shouted that he had touched it and asked his companions whether they had recorded the stunt. The video also showed him staying in the water and making a second attempt to approach the animal.
“Body slam” is best understood as a description of the apparent intention, not a literal wrestling move or a confirmed account that the man landed on the whale. The clip establishes that he jumped toward the orca and tried to approach it. It does not establish that he was eaten, attacked, seriously injured, or that he physically struck the animal.
How was he caught?
The video was shared on Instagram and later reported to DOC by members of the public. DOC worked with police to identify the man. On May 21, 2024, DOC announced that he had been issued a NZ$600 infringement fine.

DOC described the conduct as showing a “shocking and stupid attitude” toward protected marine mammals. The department also said the stunt showed reckless disregard for both the man’s safety and the welfare of the orca.
That fine is the documented aftermath—not an orca attack. The official release does not say that the man was arrested, prosecuted in court, or convicted, and it does not report a serious injury to either the man or the whale.
Why was jumping toward the orca illegal?
New Zealand’s Marine Mammals Protection Regulations define “whale” broadly enough to include killer whales, or orcas. The rules prohibit disturbing or harassing marine mammals and restrict how close people and vessels may get.

- People in the water must generally remain at least 100 metres from a whale unless authorized.
- Vessels generally must remain at least 50 metres from a whale.
- Vessels must avoid disrupting a marine mammal’s normal behavior.
- If an animal becomes disturbed or alarmed, people must abandon the contact.
Swimming toward a whale is therefore not merely bad etiquette. DOC characterized this incident as a clear breach of New Zealand’s marine-mammal protection framework because it involved swimming with, disturbing, or harassing a protected animal.

There is an important distinction between the regulation’s wording and DOC’s public safety guidance. In a February 2024 warning, DOC urged boats and kayaks to stay 50 metres from whales, including orcas, and to increase that distance to 200 metres when calves are present.
The regulations themselves contain a 200-metre approach restriction for certain female baleen or sperm whales accompanied by calves. That should not be simplified into a claim that every approach to every orca with a calf automatically has a universal 200-metre statutory limit. The practical message is nevertheless clear: a calf nearby is a reason to give marine mammals more space, not an invitation to get closer.
Could the orca have hurt him?
Yes. DOC said the incident could have ended with the man being harmed or the startled whale being injured. That is an assessment of the danger, not a report that either outcome occurred.
Orcas are powerful wild animals, and a person who jumps into the water near one has little control over what happens next. Even if the animal does not behave aggressively, a sudden movement, tail strike, collision, or panicked reaction could cause serious injury. The whale could also be disturbed or injured while trying to avoid the person.

What should someone do if an orca approaches?
People should not try to swim with or approach an orca. DOC guidance says that if an orca approaches while someone is swimming, the swimmer should calmly leave the water. Around a boat, operators should follow the required separation distances, avoid sudden or disturbing movements, and allow the animals to determine whether any interaction occurs.
That last point matters even when an orca appears calm or curious. A wild animal approaching a vessel does not give a person permission to touch it, jump into the water, chase it, or block its path. The safest encounter is one in which the animal can leave without being followed or pressured.
Why does this matter for New Zealand’s orcas?
DOC estimates that New Zealand’s coastal orca population contains approximately 150 to 200 individuals and classifies the population as nationally critical. The animals range widely around the country and may enter shallow bays and estuaries, so encounters can occur surprisingly close to shore.

The issue is not only that one person made a dangerous choice. Approaching a protected animal at close range can disrupt its normal behavior, place a calf at additional risk, and normalize wildlife interactions that other people may copy.
DOC’s information on New Zealand killer whales explains more about the species and its conservation status. Orca and killer whale are two names for the same species, Orcinus orca.
The bottom line
The attempted “body slam” did not end with a documented whale attack. It ended with the man surviving, being identified after members of the public reported the footage, and receiving a NZ$600 fine. The more serious lesson is that a protected wild orca is not an attraction to be touched: keeping away protects the person, the whale, and any calf traveling nearby.
