The case may go to court, where a judge can decide what should happen to the dog. Destruction is possible in some cases, but seizure alone does not mean the dog will automatically be destroyed. The legal route depends on where the seizure happened and the power used.
What happens after a dog is seized?
The exact process varies, but seizure generally allows the authorities to investigate a dog-related offence or concern. Under the Dangerous Dogs Act 1991, seizure powers apply in specified circumstances, including certain prohibited-type dogs and dogs that appear dangerously out of control. The power used, the location and the circumstances all matter; other laws may also apply.
- The authorities establish the basis for seizure. Ask which authority took the dog and what statute or power it relied on. Some searches of premises require a warrant, but the rules depend on the power being used.
- The dog may be held while evidence is gathered. National Police Chiefs’ Council operational guidance describes seizure as a way for specialist officers to identify a dog and assess its behaviour and the owner’s suitability. It does not guarantee a particular kennel arrangement or process in an individual case.
- The authorities decide whether the case will proceed. A prosecution or other court application may follow. The court considers the evidence and, where the relevant law applies, decides what order to make about the dog.
There is no single UK-wide holding period or release timetable established by the official guidance. It also does not determine where a particular dog will be kept or when it will be returned.
Can the dog be destroyed, or might it be returned?
A court may order a dog to be destroyed in some cases. But seizure is not itself a destruction order: the outcome depends on the offence, the evidence and the law in the relevant nation.

For specified Dangerous Dogs Act offences, the court can make an exception to destruction if satisfied that the dog would not be a danger to public safety. In deciding that, the court must consider the dog’s temperament and past behaviour, and whether its owner or handler is a fit and proper person. Where applicable requirements are met, a court may make a contingent destruction order instead. The dog may then be kept subject to the conditions of that order; the precise requirements depend on the case.
In England, GOV.UK says a police or council dog expert assesses whether a dog is a banned type and whether it may be a danger. That guidance concerns banned-dog assessment in England; it should not be treated as a description of every seizure across the UK.

How the process differs across the UK

These routes are not interchangeable. The nation, alleged offence, location of the incident and legal power used can change what happens next.
Who may have to pay costs?
In qualifying cases, a court can order payment of reasonable costs for holding or destroying a dog. A court may also make a recovery order for seizure and detention expenses. Whether costs are sought or ordered depends on the case and the applicable law.

What to ask if your dog has been seized
Contact the seizing police force or council, or a legal adviser, to establish the facts that determine the next steps. Ask:
- Which authority seized the dog, and under what statute or power?
- Where is the dog being held, and who can provide updates about its welfare and the case?
- Is the allegation that the dog is a prohibited type, dangerously out of control, or something else?
- Has the owner been charged, given a court date, or told that a court application is being made?
- Has a court made an order already, and is there an appeal deadline?
Get case-specific legal advice promptly if there is a charge, hearing, order or appeal deadline. The procedure and any deadline depend on the jurisdiction and the order; the official guidance does not establish one UK-wide contact route or appeal timetable.
