What Responsible Ownership Requirements May Apply to Restricted Dogs

Restricted-dog rules vary by place and classification. Compare current official requirements in the UK, Victoria and Tasmania, from muzzles and microchips to transfers and appeals.

“Restricted dog” is not a single legal category. Whether any condition applies to your dog depends on your country, state or province, council area, and the dog’s formal classification. Where such rules exist, they usually cover the same ground: a muzzle and lead in public, permanent identification, secure housing, notifying authorities of changes, and limits on moving or transferring the dog. The details differ enough that one place’s rules can’t safely be applied to another.

This guide compares current official rules from the UK, Victoria (Australia) and Tasmania (Australia). It isn’t legal advice and doesn’t cover every jurisdiction. Use it to learn what to ask, then confirm the specifics with your own council, state agency or national authority.

First, establish whether the rules apply to your dog

Check two things before treating any listed condition as yours: which authority’s law covers where you live, and whether your dog has actually been classed as restricted or banned there.

  • Jurisdiction. Rules can sit at national, state or provincial, or municipal level, and a local council may add its own. The three examples below are from official UK, Victorian and Tasmanian guidance only.
  • How classification works. UK guidance says a banned type is judged by what the dog looks like, not by its breed name or what it is called. Tasmania says its restricted-breed declaration is based on breed rather than behaviour. Victoria’s process involves an authorised officer’s declaration, which can be reviewed.
  • Whether you hold a formal status. In the UK, keeping a banned-type dog legally requires a valid Certificate of Exemption. In Victoria and Tasmania, the duties follow a declaration made by the council or authorised officer.

“Not listed” or “not stated” means the official page reviewed doesn’t mention the point. It doesn’t mean no rule exists, so check with the authority.

United Kingdom: exempted banned types and XL Bully dogs

UK government guidance lists the Pit Bull Terrier, Japanese Tosa, Dogo Argentino, Fila Brasileiro and XL Bully as banned types. Keeping one requires a valid Certificate of Exemption, and the owner must comply with its conditions. The guidance is published on GOV.UK by the Department for Environment, Food & Rural Affairs (DEFRA). Confirm which UK nation it applies to where you live, since dog legislation can differ between nations.

Current exemption conditions

  • The dog must be neutered and microchipped.
  • It must be secured so it cannot escape.
  • It must be on a lead and muzzled in public.
  • The owner must be over 16.
  • The owner must let an authorised officer read the microchip and produce the exemption certificate within five days of a request.
  • The owner must notify the Index of Exempted Dogs of relevant changes, such as a change of address or the dog’s death.

Insurance: no longer required from 1 July 2026

Older pages describe third-party public-liability insurance as a lasting condition of exemption. Current DEFRA guidance, checked on 7 October 2026, says otherwise: “You do not need third party public liability insurance for banned breed dogs, including XL Bully dogs.” That applies from 1 July 2026. If you hold a certificate issued under the earlier rules, read the current guidance rather than the wording on older documents or articles.

Scheduled change: children and XL Bully dogs from 1 November 2026

This condition is not yet in force as of 7 October 2026. From 1 November 2026, the exemption condition will prohibit leaving a child under 12 in close contact with an XL Bully dog in a private place without adult supervision. If you keep an XL Bully, plan household routines around it now.

Victoria, Australia: declared restricted-breed dogs

Victoria’s official guidance sets out a long list of ongoing duties for a declared restricted-breed dog.

  • Desexing and identification. The dog must be desexed and have an ISO microchip, with the number reported to the registering council.
  • Signs. Prescribed warning signs must be displayed at entrances.
  • Enclosure. The dog must be kept in a secure enclosure that meets detailed construction requirements.
  • Collar. The dog must wear a prescribed, visible collar. The page specifies alternating red and yellow reflective stripes, durable material, and a minimum width that depends on the dog’s weight.
  • Outside the premises. The dog must be muzzled and leashed, under the control of a person aged 18 or older.

Notifications, limits and transfers

You must tell the registering council within 24 hours of specified changes: the dog going missing, a change of ownership or address, or a move to a different municipality. A person generally must not own more than two restricted-breed dogs without a council permit.

Restricted-breed dogs cannot be sold, given away or transferred, with stated exceptions. Two examples are surrender to a council pound or shelter, and transfer to an eligible immediate family member after the owner’s death.

Challenging a declaration

An owner can apply to the Victorian Civil and Administrative Tribunal (VCAT) for review of a declaration within 14 days. The guidance also says a declaration by an authorised officer shifts the evidentiary presumption in proceedings, provided the officer has completed the approved training it describes. Because that affects how a case is argued, get advice specific to your dog before relying on a review.

Tasmania, Australia: declared restricted-breed dogs

Tasmania’s guidance names five restricted breeds and stresses that declarations rest on breed, not behaviour. A well-trained dog of a listed breed can therefore still be declared.

  • In public. The dog needs a muzzle and a lead no longer than two metres, held by a capable person over 18. One person may control no more than two restricted-breed dogs in public at once.
  • Desexing and microchipping. Both must be done within 28 days of declaration, with a veterinarian’s certificate supplied to the council.
  • At home. Approved warning signs must be displayed at every property entrance, and the dog must wear an approved collar.
  • Number limit. One person may own or keep no more than two restricted-breed dogs.
  • Notifications and moves. Council deadlines apply to a missing or deceased dog and to moves. Written council approval is required before transfer, and a dog arriving from interstate must be reported within seven days.

An owner has 28 days to appeal a declaration to the Tasmanian Civil and Administrative Tribunal.

Practical notes on the physical requirements

Muzzles

All three examples require muzzling in public. The official pages reviewed don’t endorse a particular muzzle design, and I haven’t tested any. Check whether your authority specifies a type, then make sure the muzzle fits your dog safely. A basket-style muzzle is a common option, but it is not guaranteed to satisfy local rules.

Collars and signs

Victoria and Tasmania both require a prescribed or approved collar and warning signs. An ordinary collar or generic “beware of dog” sign does not necessarily comply. Check the current specification, including colours, reflective striping, width for the dog’s weight, and sign wording and placement, with your council before buying.

Responsible ownership beyond the legal conditions

Legal conditions for a restricted dog are different from general ownership policy. The UK government’s dog-control taskforce report notes that, in the UK, dogs must be microchipped and owners have welfare duties. It presents ideas such as mandatory insurance, owner-knowledge conditions or licensing as matters recommended for consideration, not as general conditions that apply to every dog today. It also describes local orders that can require a lead, a muzzle, training or a secure garden in response to dog-related problems.

So even if your dog isn’t classed as restricted, a local order may still apply to it. Likewise, a good practice you read about, such as a training course, is not necessarily a legal duty for your dog.

A checklist for owners

  1. Confirm the country, state and council whose rules govern where the dog lives.
  2. Get the dog’s classification in writing: certificate, declaration notice or council record.
  3. Note the deadline and forum for any challenge. These are 14 days at VCAT in Victoria and 28 days at the Tasmanian tribunal, and each runs from the declaration.
  4. List the conditions that apply: public control, identification, desexing, housing, signs and collar, and number limits.
  5. Record every notification deadline. Examples: 24 hours in Victoria, seven days for interstate arrivals in Tasmania, and notifying the Index of Exempted Dogs in the UK.
  6. Before moving, rehoming or travelling with the dog, ask the authority first. In Victoria especially, transfer is largely prohibited.
  7. Recheck official pages periodically. Rules change, as the UK insurance change and the child-supervision condition show.
