Breed-based insurance rules can make it harder for some dog owners to rent or keep a home, but the legal protections depend on where you live and what decision is being made. The federal Fair Housing Act does not list dog breed as a protected category for ordinary pets. Some states limit breed-based decisions by property insurers, while proposals in New York and Massachusetts would address additional kinds of insurance or housing.
What does federal fair-housing law protect?
The U.S. Department of Housing and Urban Development’s Fair Housing Act overview lists race, color, national origin, religion, sex, familial status, and disability as protected characteristics. Dog breed is not listed as a standalone protected category. That means the federal law does not, by itself, make an ordinary pet breed restriction illegal.

Disability-related requests involving assistance animals are a separate legal question. An assistance animal is not simply an ordinary pet with a different label, and a request for a disability-related accommodation should be assessed under the applicable rules rather than treated as a routine pet-policy dispute. How can an insurance rule affect housing?
A landlord may consider insurance requirements when deciding whether to allow a dog, but an insurer’s breed rule and a landlord’s pet policy are separate decisions. Some landlords may rely on insurer requirements; others may set their own restrictions. Do not assume that an insurer caused a particular denial unless the landlord or insurer confirms it.

Insurance decisions can take several forms: refusing to issue a policy, declining to renew or cancelling one, charging a higher premium, or excluding a dog-related claim or limiting coverage. A law that bars one type of decision may not address all the others, and a rule for homeowners insurance may not apply to renters insurance or rental housing.
Where do state protections and proposals stand?
The ASPCA’s overview identifies Nevada, New York, and Colorado as states with laws limiting property insurers’ ability to deny coverage based on specific dog breeds. It describes these laws as requiring consideration of an individual dog and objective factors such as bite history. This is a useful starting point, not a substitute for checking current state law: the precise insurance lines, decision types, exceptions, and effective dates can differ.

These approaches are not interchangeable. New York’s proposal names renters insurance as well as homeowners insurance; the Massachusetts Senate announcement describes state-aided public housing and homeowners insurance. Neither proposal should be presented as a current entitlement without confirmation of enactment, final text, and effective date.
What can you do if a landlord or insurer cites your dog’s breed?
- Identify the decision-maker and the decision. Ask whether the restriction comes from the landlord, a property manager, an insurer, or a policy requirement. Find out whether the issue is permission to keep the dog, policy eligibility, renewal, a premium, or an exclusion or limit.
- Request the reason in writing. Ask for the relevant lease or pet-policy term, insurer notice, or underwriting explanation. A written explanation can help distinguish an actual insurance condition from a landlord’s independent rule.
- Check the law for your location and coverage type. Look for current state statutes and guidance from your state insurance regulator. Confirm whether a protection applies to renters or homeowners insurance, private rentals or public housing, and the specific action at issue. If a bill has passed a legislative chamber, check for final enactment and its effective date.
- Ask whether the decision can be based on individual facts. If your state law requires individual consideration, ask what objective information the insurer will accept, such as documented behavior or bite history. Do not assume that a general statement about a state law guarantees coverage or overrides every underwriting rule.
- Keep records and seek help where appropriate. Save notices, emails, policy documents, and dates of conversations. Contact a state insurance regulator about an insurance decision, or a fair-housing organization or attorney about a housing dispute. For a disability-related assistance-animal request, use the separate accommodation process.
How can you support broader change?
Policy advocacy can focus on requiring individual assessment rather than using breed alone, and on making clear which insurance decisions and housing settings a law covers. The ASPCA describes its work on breed-specific insurance discrimination and invites readers to join its Advocacy Brigade.

Massachusetts Senate President Karen E. Spilka described the PETS Act in the Senate announcement this way: “Pets are family, and this bill makes it clear they should be treated that way.” Senator Pavel M. Payano, sponsor of provisions described as ending breed discrimination and expanding pet ownership in public housing, said: “In Massachusetts, no one should face higher insurance costs because of a dog’s breed, be forced to choose between housing and their pet, or be burdened by unclear and rising pet fees.” These are legislators’ statements in support of proposed legislation, not neutral findings about the law’s effects.
When contacting lawmakers, ask them to specify whether a proposal covers private rentals, public housing, renters insurance, and homeowners insurance—and whether it addresses eligibility, cancellation, renewal, premiums, exclusions, and coverage limits. Those details determine what a protection would actually do.
