Kerala’s festival-parade rules already require safety and welfare safeguards, but a key requirement—“sufficient space” between elephants—was not defined by a clear distance in the court record after the Tirur stampede. That gap makes the case for more operational standards and accountable enforcement. It does not prove that one new rule would have prevented the incident, or that Kerala alone represents the whole of India.
What happened at Tirur, and what did the court ask?
On 8 January 2025, an incident involving a captive elephant at Tirur was followed by a stampede. In its 13 January order, the Kerala High Court recorded one death and injuries to more than 29 people. The court asked the state government to clarify what “sufficient space” means under Rule 10(4)(i) of the Kerala Captive Elephants (Management and Maintenance) Rules, 2012, including what distance should be maintained between elephants in processions and parades.

The sequence points to a regulatory problem: a rule can set a safety obligation without giving organisers and enforcement officials a measurable standard for applying it. But the court record does not establish that ambiguity in this provision caused the Tirur incident, nor does it show that a particular distance would have prevented it.

The Kerala Forest Department lists the 2012 Kerala Captive Elephants (Management and Maintenance) Rules among the state’s rules. The Kerala High Court has said they were framed under section 64(2) of the Wildlife (Protection) Act, 1972. The department also lists separate 2003 rules; the High Court’s 2024 and 2025 orders identify the 2012 rules as the framework relevant to the parade issues discussed here.

Upkeep, records and veterinary care
In an order dated 13 November 2024, the High Court described Rule 4 as addressing upkeep and veterinary care. It referred to requirements including engaging a mahout with at least three years’ experience in elephant management. The order also said that, when issuing a medical certificate, original ownership, microchip, insurance and elephant-data-book documents should be verified.
Parade safeguards and enforcement
The same order directed strict compliance with Rule 10 during temple-festival parades. It said contraventions should be dealt with under section 51 of the Wildlife (Protection) Act. That is a judicial direction about enforcement; it is not evidence that every festival complied, or that every festival failed to comply.

Is a three-metre gap currently required?
Not on the basis of the court record cited here. The High Court’s 13 January 2025 order says its earlier direction for a three-metre minimum had been stayed by the Supreme Court on 19 December 2024. The same order notes that the Supreme Court continued to require strict compliance with the existing 2012 rules. The three-metre direction should therefore not be described as a currently operative statewide rule.
In a 21 January 2025 follow-up, the High Court recorded the state’s account of a stakeholder workshop and field trial. The state said one universal distance might not be practically feasible because spacing depends on the elephants, terrain and conditions. That is the state’s position in the court record, not proof that measurable safety standards cannot be set. A standard could, for example, specify a baseline and explain how any event-specific adjustment must be justified and monitored; the orders cited here do not prescribe that design.

What do the numbers say—and what can’t they establish?
Figures cited in court proceedings and media reporting use different dates, sources and definitions. They should not be combined into a single current count or treated as a consistent measure of violence.
| Figure | What it represents | Qualification |
|---|---|---|
| 2,675 captive elephants nationally, including 518 in Kerala | A Ministry of Environment, Forest and Climate Change affidavit filed in 2019, as recited by the Supreme Court on 18 August 2026. | A 2019 figure cited in a 2026 order, not a contemporaneous estimate. |
| 2,725 captive elephants nationally | A figure from proceedings of the sixth meeting of the Captive Elephant Healthcare and Welfare Committee in 2026, as recited by the Supreme Court on 18 August 2026. | A separate 2026 figure; it is not directly comparable to the 2019 count without consistent methods and dates. |
| 1,821 elephants in private custody; 723 without ownership certificates or with applications under review | Ministry figures from an RTI response reported by Scroll. | Reported secondhand; the underlying response was not independently confirmed here. |
| 60 violent incidents during the last two Pooram festivals | Data shared with Scroll by animal-rights organisations. | Attributed data; the incident definition and source matter. |
| 196 people killed by captive elephants in Kerala from 2011 to 2023 | A figure reported by Scroll. | The opened report did not provide an underlying official dataset. |
| 154 captive elephants dead since 2018, among more than 500 recorded in Kerala | A figure Scroll attributed to the Kerala High Court. | The cited judgment and denominator would need to be checked before treating this as an independently verified total. |
The Tirur fatalities and injuries are specifically recorded in a court order. The other figures above are not equivalent evidence: several are attributed to media reporting or outside organisations, and the available material does not establish a unified, current official Kerala dataset with consistent definitions for attacks, deaths and elephant population. Incidents involving captive elephants at festivals also should not be conflated with wild-elephant conflict.

Why does Kerala’s case matter to India’s national framework?
Kerala’s rules govern the state framework described in these court orders; they are not the law for every captive elephant in India. But the Supreme Court’s 18 August 2026 order shows that national oversight faces related questions about identity, traceability, healthcare and welfare.

The order directed a report on whether DNA profiling of captive elephants had been completed and the data entered in Gajah Suchana. It also called for steps concerning elephant clinics, medical records, welfare standards, and safeguards for transfers and ownership. The order identifies publication of Principles of Captive Elephant Management: A field manual by the committee. These directions address systems for tracking and caring for elephants, as well as risks that can arise when an animal changes custody.

Identity records matter because a certificate or database entry is only useful if it reliably corresponds to the elephant and its history. Bharati Ramachandran, chief executive officer of the Federation of Indian Animal Protection Organisations, told Scroll: “Today, nothing stops someone from claiming that an elephant was born in captivity even if it was captured from the wild.” That is her assessment, not a court finding. The Supreme Court’s attention to DNA profiling and Gajah Suchana makes verification and reliable records a national governance issue, without itself resolving individual provenance disputes.
What would a more effective legal regime need to do?
The court proceedings point to a gap between written safeguards and the systems needed to apply and verify them. Reforms should make duties clear for each responsible party and make compliance observable, rather than relying only on broad instructions to follow existing rules.
| Reform area | What clearer governance could address |
|---|---|
| Parade spacing and event safety | Define a measurable baseline or event-specific method for applying “sufficient space”; state who assesses conditions, records decisions and can halt a parade when safeguards cannot be met. |
| Ownership and identity | Make ownership, microchip, DNA and elephant-data-book records consistent and verifiable, with clear procedures for transfers and disputed or incomplete documentation. |
| Responsibility and enforcement | Specify the duties of owners, handlers, event organisers and regulators, and how contraventions are documented and referred for enforcement under applicable law. |
| Ongoing welfare | Make care expectations—healthcare, records, housing, rest and other welfare needs—practical to inspect and consistently monitor. |
| Monitoring and public reporting | Use consistent definitions and reporting for incidents, deaths, custody and compliance, so the public and authorities can distinguish a verified trend from a collection of differently sourced claims. |
These are analytical criteria drawn from the issues raised in the court orders, not a statement that each is already a statutory test. The immediate lesson is more specific: a direction to maintain “sufficient space” is difficult to enforce consistently if the responsible authority has not explained how sufficiency is judged. At the same time, distance alone cannot address the full set of welfare, recordkeeping and accountability questions before the courts.

The legal record supports a case for clearer, enforceable standards and accountable implementation. It documents a fatal stampede after the Tirur incident, a judicial request to operationalise parade spacing, and later national directions on records, healthcare, welfare and transfers. It does not establish a comprehensive long-term trend in captive-elephant violence, prove that one rule change would prevent all incidents, or demonstrate the extent of compliance across Kerala’s festivals. Keeping those limits clear makes the case for reform stronger: rules need to be specific enough to apply, and oversight needs to show whether they are being followed.
