Elizabeth Pitt, a lesbian social worker employed by Cambridgeshire County Council, received £55,910.15 in compensation after the council admitted liability for harassment related to her gender-critical beliefs and sexual orientation. The “gender-fluid dog” phrase refers to the conversation that began the workplace dispute—not to the legal claim itself. The tribunal recorded the outcome by consent, rather than issuing a contested ruling on liability after a full trial.
What was the “gender-fluid dog” conversation?
The conversation took place during a Zoom meeting of the council’s LGBTQIA+ group. According to the employment tribunal’s costs judgment, an attendee said he identified his dachshund as gender-fluid and put a dress on the dog to prompt a discussion about gender. Pitt and a lesbian colleague expressed gender-critical views during the exchange. The official account reports what the attendee said; “gender-fluid dog” is shorthand used in media coverage, not the name of the legal case.

The tribunal materials do not provide Pitt’s complete verbatim comments, so her words should not be quoted as though they were recorded in the judgment. The legal dispute concerned the council’s subsequent treatment of her at work.

Following complaints, the council investigated and issued Pitt a written management instruction. It told her to ensure her personal views did not manifest in workplace comments or actions that might discriminate against others. It also instructed her not to contact members of the group or attend its events. The costs judgment describes this as the informal stage of the council’s disciplinary procedure; it does not describe Pitt as having been dismissed.

Did Pitt win her tribunal claim?
The council admitted liability for harassment relating to Pitt’s gender-critical beliefs and sexual orientation on the first day of the final hearing, 29 July 2024. The parties then agreed the remedy, and the tribunal recorded both the harassment outcome and compensation in a consent judgment dated 16 August 2024. That is an agreed liability outcome, not a fully reasoned tribunal decision on contested liability after a trial.
The consent judgment said written reasons would not be provided unless a party requested them within 14 days of the written record being sent. That notice does not establish whether anyone requested reasons or whether further reasons were later issued.

What did the tribunal say in its reasoned costs judgment?
The separate costs judgment contains the tribunal’s reasoned findings about costs—not a contested merits judgment on liability. The tribunal found the council had no reasonable prospect of defending the claim insofar as it concerned the manifestation of Pitt’s gender-critical beliefs. It said contemporaneous documents were “totally and inexplicably” inconsistent with the council’s case that the expression of those beliefs played no part in its conduct.
The tribunal also accepted that the documents left room for the council to argue that its actions were substantially motivated by what it perceived as the insensitivity or manner of Pitt’s expression. It awarded £8,000 on a broad-brush assessment rather than the full costs sought. In explaining its conclusion, the costs judgment said “the contemporaneous documents unambiguously show that at least part of the reason for the respondent’s impugned conduct was its response to the manifestation of the claimant’s gender-critical beliefs.”

What change did the tribunal recommend?
The consent judgment recommended that the council revise its mandatory essential e-learning to include a section on freedom of belief and speech in the workplace. It specified that counsel Anya Palmer should draft the section and that it should be available to employees within six months. The order also recommended sending Pitt a copy and confirming the release date. This was a recommendation in the judgment.
What is the formal case name?
The case is Ms Elizabeth Pitt v Cambridgeshire County Council, employment tribunal case number 3311160/2023. The dog-related exchange explains the shorthand in some headlines, but the case was about Pitt’s workplace treatment and her claims of harassment related to belief and sexual orientation.
