Why Rabbit Breeding Regulations in England Need to Change

England regulates some rabbit sales, but breeding oversight is not universal. Licensing, correct sexing, council enforcement resources and stronger welfare standards are among the reforms raised in Parliament.

England has rules for some animal sellers and practical guidance for rabbit sales, but it does not have a universal rabbit-breeder licensing system. The case for change is to close that gap: require explicit oversight of breeding, improve safeguards such as accurate sexing, give local authorities the resources to enforce rules, and make welfare standards more enforceable. Scotland already licenses rabbit breeders; its rules show what licensing can cover, though evidence reviewed does not establish that licensing alone improves welfare outcomes.

What rules apply to rabbit breeding and sales in England now?

England does regulate some animal-selling activities. Under the Animal Welfare (Licensing of Activities Involving Animals) (England) Regulations 2018, sellers covered by the regime must follow licensing conditions. Local-authority statutory guidance says licensed sellers must not sell rabbits younger than eight weeks and sets rabbit-specific expectations for enclosure size, temperature, transport, housing, diet and enrichment. For diet, the guidance calls for constant access to hay or grass. These are concrete safeguards, but they do not amount to a universal licensing system for rabbit breeders. Read the statutory guidance for local authorities.

There is also a rabbit on-farm welfare code. The government explains that codes are not law, although failure to follow them can be used as evidence in court when determining whether legislation has been breached. That code concerns farm rabbits; it should not be treated as a complete set of rules for every companion-rabbit breeder. Its legal status helps explain why campaigners seek stronger, clearer duties. See the government’s rabbit on-farm welfare code information.

In a parliamentary question, a member asked whether the 2018 licensing regulations should be amended after the 2024 post-implementation review to make rabbit breeding licensable, require rabbits sold to be correctly sexed, provide additional resources to local authorities, and give the rabbit welfare code statutory footing. In its answer on 2 March 2026, the government pointed to the Animal Welfare Strategy published in December 2025 and its commitments to improve welfare standards, compliance with the licensing regime and consistent, effective local-authority enforcement. The answer does not say that the specific rabbit measures requested have been adopted. Read the parliamentary question and answer.

Why are campaigners calling for change?

Breeding can fall outside a consistent licensing framework

Without rabbit breeding as an explicit licensable activity, the existence and scope of oversight can depend on which activity a person undertakes and whether it falls within the existing regime. A clearer rule could set minimum requirements for breeders and give councils a defined basis for licensing and inspection. Licensing would only help if its conditions are meaningful and enforcement is practical.

Buyers may struggle to assess listings and sellers

RSPCA campaign-page figures point to the scale of online sales: it says more than 30,000 advertisers posted nearly 117,000 rabbit-sale listings from 2018 through 2024, representing an estimated 350,000 rabbits for sale. It also says more than 35,000 rabbits were listed on one animal-selling platform in 2024. These are advocacy-organization figures, not identified as official government statistics; the page does not provide an underlying methodology or independent audit. They indicate a potential oversight challenge, not proof that every listing is unlawful or that a particular rule would prevent harm. See the RSPCA campaign page and its figures.

Sexing errors can create avoidable welfare and ownership problems

Requiring rabbits sold to be correctly sexed would give buyers a clearer safeguard and could help prevent unexpected litters when rabbits are housed together. The parliamentary question specifically proposed such a requirement. The government answer did not confirm that it had been introduced, so it remains a reform proposal in the evidence available here.

Rules need enough enforcement capacity to matter

A licence or statutory standard is only useful if local authorities can check compliance and respond when conditions are breached. The parliamentary question explicitly called for additional resources, and the government’s 2026 answer referred generally to consistent and effective local-authority enforcement. It did not specify a rabbit-specific funding commitment. RSPCA says six local authorities had issued licences for rabbit breeders or sellers as of early 2025; that is a campaign-page figure, not an official national count established in the government material cited here.

What can licensing cover? Scotland provides a practical example

Scotland has a specific rabbit-breeder licensing regime. Its guidance requires the local authority to set a maximum number of breeding females for each licensed premises, and a breeder must obtain approval before increasing that number. Rabbit-sale adverts must include the licence number and the issuing local authority. The guidance also describes access to clean, dry sleeping areas and exercise areas. Read Scottish Ministers’ rabbit-breeder guidance.

Scottish regulations also set limits and suitability rules. They restrict a female rabbit to four litters in any 12-month period and 16 over her lifetime; prohibit mating before five months or at six years and older; and prohibit breeding where genotype, conformation, behaviour or health could reasonably be expected to harm the rabbit or its offspring. They say adult rabbits should not be isolated longer than necessary. These rules illustrate how a licence can impose welfare-related conditions, rather than serving only as a registration or paperwork requirement. Read the Scottish regulations.

This is a comparator, not a claim that the UK has one uniform rabbit-breeding law. The available sources establish a specific Scottish regime and England’s different mix of licensing rules, sales guidance and codes; they do not provide a complete current comparison with Wales and Northern Ireland.

Why does the legal status of a welfare code matter?

Guidance can describe good practice and may be relevant evidence in court, but that is different from a mandatory standard whose breach itself carries a legal consequence. In England, the government says the rabbit on-farm code is not law, although non-compliance may be used as evidence when considering breaches of legislation. Campaigners’ call to put the code on a statutory footing is therefore about making the standards’ legal role clearer and stronger. Any change would need to specify which rabbits and activities it covers; the farm code should not automatically be assumed to govern companion-animal breeding.

The Australian Capital Territory offers a different model. Its Animal Welfare (Keeping and Breeding of Rabbits in the ACT) Mandatory Code of Practice 2024 applies to people who own, keep, care for or breed rabbits in the territory. Its statutory instrument says failure to comply with mandatory standards can be an offence under the Animal Welfare Act 1992. This is an example of enforceable standards with broad coverage, not a rule that applies in the UK. Read the ACT mandatory code.

Which reforms would address the gaps?

Reform option What it could do Key design question
Make rabbit breeding a licensable activity Set a clear entry point for breeder oversight, inspection and enforceable licence conditions. Which breeders and premises are covered, and what scale or activity triggers a licence?
Require correct sexing of rabbits sold Give buyers a specific safeguard and reduce the risk of accidental breeding after purchase. How is competence demonstrated, and what remedy applies when a rabbit is mis-sexed?
Resource local-authority enforcement Help councils administer licences, inspect premises and respond to non-compliance. What funding, training and consistent enforcement expectations will be provided?
Give welfare standards stronger legal force Clarify which standards are binding and what consequences follow a breach. Does the standard cover companion rabbits, farm rabbits, or both, and how are the rules kept current?

These measures work best as a coherent system: licensing identifies who is accountable; clear welfare conditions define acceptable practice; accurate-sale rules protect buyers and animals; and adequately resourced enforcement gives the requirements practical effect. The details matter. For example, Scotland’s breeding limits and suitability provisions address specific risks, while the ACT code uses mandatory standards for a wider group of rabbit keepers.

What is established—and what remains uncertain?

The cited sources establish that England has rabbit-specific sale guidance, that the government has made general animal-welfare and enforcement commitments, and that specific rabbit licensing and statutory-code changes were raised in Parliament. They do not establish that the requested amendments were adopted, quantify how many rabbits would benefit, or measure the effect licensing has on welfare outcomes. No named statistic or independent evaluation of the proposed reforms’ expected impact is established by these sources. A sound case for reform should therefore rest on closing defined oversight gaps and making responsibilities enforceable, not on claiming a proven numerical improvement.

RSPCA attributes the following advocacy statement to Rae Walters, CEO of RWA&F: “We urgently need to see these intelligent, social animals given greater protection under law.” It is the campaign organization’s position, not a government conclusion. Read the statement.
