Bayswater’s 2024 proposal to require cats in public places to be under “effective control” was disallowed by Western Australia’s Legislative Council in September 2025. A state bill introduced in 2026 could give councils express power to make cat-containment laws, but the official updates identified here still described it as proposed reform—not a law—and do not establish a new Bayswater amendment.
What happened to Bayswater’s effective-control proposal?
The City’s 2024 amendment would have added a rule called “Cats in other places.” It proposed requiring a cat in a public place to be under effective control, as judged by an authorised person. On non-public property, it would have required the occupier’s consent as well as effective control. The City proposed a $250 penalty for an offence; that was a proposed penalty, not one established by the amendment.

Bayswater Council resolved to make the amendment in October 2024. The Legislative Council disallowed it on 16 September 2025. The City’s update the following day confirms the outcome and says the 2022 Keeping and Control of Cats Local Law, including its 2023 amendments, remains in force.

The disallowance followed the Joint Standing Committee on Delegated Legislation’s view that, under the Cat Act as it then stood, local laws should not require cats to stay on their owners’ properties or impose extra conditions such as effective control on roaming cats. The committee considered such requirements outside the authority available under the Act. This was the committee’s interpretation and a Legislative Council decision, not a court ruling. The committee’s position is set out in its report on specific local laws; the Council debate is recorded in Hansard.

What cat rules apply in Bayswater now?
The City says its current local law prohibits cats from 43 designated sites. Examples include Eric Singleton Bird Sanctuary, Gobba Lake and the Bayswater Industrial Area. These site-specific restrictions are distinct from the disallowed 2024 proposal: they do not mean that a new general rule requiring every cat in a public place to be under effective control is in force.
The City’s local-law history describes an initial 2022 draft that included an effective-control rule and proposed restrictions at 42 natural areas. After the original effective-control clause was removed following the State committee’s objection, Bayswater proceeded with designated-area rules; the City says its 2023 amendments brought the prohibited-site list to 43.

During the 2022 consultation, the City reported that 72% of respondents supported the draft law generally, 70% supported the proposed effective-control clause and 91% supported the natural-areas clause. These are figures for consultation respondents, not evidence of the views of all Bayswater residents.
Could a new WA law let Bayswater try again?
The State introduced the Cat Amendment (Local Laws) Bill 2026 in the Legislative Assembly on 25 February 2026. Minister for Local Government Hannah Beazley said the bill would provide councils with “clarity and certainty” about their power to enact cat-containment local laws, according to the second-reading speech.

If enacted, the bill is intended to let local governments choose measures such as restricting cats to their owners’ premises, prohibiting cats from public places, setting conditions for public access or establishing curfews. It would create a framework for council decisions; it would not itself enact a Bayswater-wide roaming ban. The State Government’s announcement, updated 17 June 2026, still described the bill as a measure to be progressed. The official material identified here does not establish that it subsequently passed or commenced.
Bayswater Mayor Filomena Piffaretti said the City had “long advocated for greater cat containment laws” and described the bill as “a step towards the introduction of greater cat containment measures in our local law to protect native animals,” in the City’s 20 February 2026 announcement. That statement signals the City’s position, not a new local rule or a confirmed decision to make another amendment.

Is the Cat Act review the same as the proposed bill?
No. The local-law bill and the broader review of Western Australia’s Cat Act are separate processes. The bill concerns councils’ authority to make cat-containment local laws. The broader review concerns the State Act, which covers domestic-cat identification, registration and sterilisation, as well as local governments’ administration and enforcement functions.
The State’s review page, updated 19 June 2026, says initial scoping had begun. Consultation feedback was accepted through 31 August 2026. A separate Department review page describes amendment drafting as progressing. Neither process, on the information identified here, confirms a new Bayswater roaming rule.

What Bayswater cat owners should take from this
- Do not treat the disallowed 2024 effective-control proposal or its proposed $250 penalty as current law.
- Check the City’s current local-law information for the designated cat-prohibited areas and any rules that apply to a particular site.
- Watch for an enacted State bill and a subsequent Bayswater Council decision before assuming a general containment rule has taken effect. The City’s 2026 support for the bill does not itself change the local law.
