The City says its separate 2022 cat local law, including 2023 amendments that prohibit cats from 43 specified sites, remains in force. A proposed statewide bill that could give councils broader powers was still before the Legislative Council at second reading in the latest record reviewed, dated 4 October 2026.
What Parliament disallowed
The disallowed measure was the Keeping and Control of Cats Amendment Local Law 2024, a City of Bayswater amendment that sought to regulate cats beyond the existing site-specific prohibitions. Council made it on 22 October 2024; it appeared in the Government Gazette on 8 November and commenced on 22 November 2024. The Legislative Council disallowed it on 16 September 2025. The City’s account and the official parliamentary record are available from the City of Bayswater and Legislative Council Hansard.

The amendment’s proposed “Cats in Other Places” clause would have required a cat in a public place to be under effective control, as judged by an authorised person. A cat on non-public property would have needed the occupier’s consent and also had to be under effective control. It also proposed a new offence penalty and adding Brickworks Lake to the Maylands Lakes cat-prohibited areas. The City said it adapted, with minor modifications, a Shire of Northam local-law clause by reference under section 82 of the Cat Act 2011.
Why the Legislative Council disallowed it
The stated parliamentary rationale was that the amendment went beyond the powers available under the Cat Act 2011. Agriculture and Food Minister Jackie Jarvis told the Legislative Council that the Joint Standing Committee on Delegated Legislation found clauses 4 and 5 unauthorised and inoperative. She cited section 79, which gives local governments power to specify places where cats are absolutely prohibited, and said the committee considered a blanket approach to public places beyond that authority. This is the rationale reported in Parliament, not an independent legal opinion.

Jarvis described section 79 as “the root cause of the issue” because it sets out the powers for making a local law. Her statement appears in the Legislative Council Hansard for 16 September 2025.
What cat rules still apply in Bayswater
The City says its separate Keeping and Control of Cats Local Law 2022 remains in force, including amendments made in 2023. Those amendments establish cat-prohibited areas at 43 sites; the City gives Eric Singleton Bird Sanctuary and Gobba Lake as examples. The disallowance removed the 2024 amendment, not those existing site-specific restrictions. Check the City’s current guidance for the applicable rules at a particular location: City of Bayswater cats.

The WA Government announced it would progress the Cat Amendment (Local Laws) Bill 2026. If enacted, the proposed bill would enable local governments to adopt rules restricting cats to owners’ premises, prohibiting cats from public areas, or imposing curfews. The Government also said councils could consider transition arrangements for people who already keep cats outdoors. These are proposed powers, not rules councils can rely on under a bill that has not become law.
